Title

Resolution authorizing the sale of City-owned vacant lots to Milwaukee Habitat for Humanity, Inc., to create building sites for its 2009 housing program, in the 6th and 15th Aldermanic Districts.

Analysis

This resolution authorizes the sale of multiple Neighborhood Properties to a buyer pursuant to Section 304-49-7, Milwaukee Code of Ordinances.

Body

Whereas, Milwaukee Habitat for Humanity, Inc., (“Habitat”) is a community-based organization that has been providing affordable housing to first-time homebuyers that qualify as low to moderate-income households in Milwaukee since 1984; and

 

Whereas, Habitat desires to build 25 single-family homes for its 2009 housing program and has submitted an unsolicited offer to purchase the following City-owned vacant lots, as summarized in a Land Disposition Report and a copy of which is attached to this Common Council File:

Whereas, Section 304-49-7 of the Milwaukee Code of Ordinances allows the City of Milwaukee (“City”) to accept unsolicited offers to purchase when the City receives fair compensation, whether monetary or non-monetary; and

 

Whereas, The sale of these lots will allow Habitat to continue to provide affordable homeownership opportunities to low and moderate-income families and will provide the City with fair compensation through additional tax base and housing opportunities; and

 

Whereas, The Department of City Development (“DCD”) recommends sale of these lots with closing contingent on DCD approval of final site and building plans and evidence of financing; and

 

Whereas, These lots will be sold in “as is” condition without representations or warranties including but not limited to soil quality and subsurface condition; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Offer to Purchase the above-identified vacant lots from Habitat is accepted; and, be it

 

Further Resolved, That the Commissioner of DCD or designee is authorized to perform such acts as necessary to carry out the intent of this resolution including accepting the Offer, executing the deed and releasing any deed restrictions that prevent construction; and, be it

 

Further Resolved, That the Commissioner of DCD may amend the Offer after notice to the local alderman pursuant to Section 304-49-2, Milwaukee Code of Ordinances, to substitute different City-owned lots in the target area in the event physical or title problems prevent conveyance of a lot or if additional lots become available due to tax foreclosure or termination of outstanding offers if the new lots are more suitable for Habitat’s program; and, be it

 

Further Resolved, That the proceeds from said sale be credited to the Reserve For Tax Deficit Fund Account No. 0001-334106, less a 30 percent disposition cost reimbursement to the Redevelopment Authority of the City of Milwaukee.
