Title
Resolution approving a lease with Charles P. Bucolt Real Estate for a portion of the property at 4200 North Holton Street for relocation of the Election Commission equipment storage, in the 6th Aldermanic District.
Analysis
This resolution will authorize lease of a portion of privately owned property for municipal use.
Body
Whereas, As a result of the acquisition of the Hawley Road Municipal Warehouse by the Milwaukee Metropolitan Sewerage District (“MMSD”) in December 2007, storage of Election Commission equipment must be relocated; and
Whereas, The Election Commission has identified approximately 12,442 square feet of storage and office space at 4200 North Holton Street that is available for lease; and
Whereas, The City Attorney’s office and City of Milwaukee (“City”) Real Estate staff have negotiated a lease with the property owner, Charles P. Bucolt, doing business as Charles P. Bucolt Real Estate, a copy of which is attached to this Common Council File; and
Whereas, The Election Commission has funds in its budget to pay for rent and utility costs and MMSD will reimburse the City for actual moving expenses and certain build-out costs as required by State Statutes governing relocation assistance; and
Whereas, The proposed lease includes a provision to expand the leased area by 3,538 square feet to accommodate storage needs of the Department of Administration (“DOA”); and
Whereas, The Election Commission has funds budgeted for 2009 to pay for the full leased area, but DOA will pay the cost for its storage in future years; and
Whereas, The City Plan Commission has approved lease of the space for municipal use; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the lease with Charles P. Bucolt, d/b/a Charles P. Bucolt Real Estate, for a portion of 4200 North Holton Street for use by the Election Commission and DOA is approved; and, be it
Further Resolved, That the Commissioner of the Department of City Development, or designee, is authorized to execute the lease with Charles P. Bucolt Real Estate on behalf of the Election Commission and DOA, upon final approval of the lease by the City Attorney’s office; and, be it
Further Resolved, That the first year rental payments shall be paid by the Election Commission through Account Nos. 0001-1700-R999-632500 for rent and 0001-1700-R999-631500 for expenses; and, be it
Further Resolved, That the lease may be renewed annually provided future rent payments are provided to the Election Commission and DOA through its respective budgets.
