Analysis

This resolution approves the termination of an Access Easement Declaration and release of an Access Easement for the property located at 318-324 North Water Street in the 4th Aldermanic District.

Body

Whereas, Graceville LLC (“Graceville”) owns the property located at 318-324 North Water Street (“Property”); and

 

Whereas, In 2003 "Graceville" requested the City to assign the Property a Buffalo Street address as the Property also has frontage on Buffalo Street; and

 

Whereas, In exchange for assigning the Buffalo Street address, the City of Milwaukee required Graceville to create a permanent access easement across the Property from Buffalo Street to the building located on the Property (“Easement”); and

 

Whereas, Graceville has redeveloped the Property such that the need for the Easement has been eliminated; and

 

Whereas, The Easement requires the City to consent in writing to any amendment or termination thereof; and

 

Whereas, The Office of the City Attorney has reviewed the proposed Termination of Access Easement Declaration and Release of Easement (“Termination”), a copy of which is attached hereto; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Termination is hereby approved, and the proper City officials, including the Commissioner of Public Works, are hereby authorized to execute the Termination.
