Analysis

This ordinance provides that, in the zoning code, the term “self-service storage facility” shall mean an enclosed storage facility having compartments, rooms, spaces, lockers or other types of units that are individually leased, rented, sold or otherwise contracted for the storage of personal or household property, where the storage areas are designed to allow private access to the units and the facility owner or operator has limited access to the units.  This term includes a mini-storage facility.  This term does not include an indoor storage facility or a wholesale and distribution facility - two other storage-related land uses defined and regulated in the zoning code.

This ordinance also provides that, for zoning purposes, the use classification of a self-service storage facility shall be as follows:

1.  Permitted use - IO, IL and IH industrial districts.

2.  Limited use - C9G downtown district.

3.  Special use - CS commercial district and C9H downtown district.

4.  Prohibited use - all other zoning districts.

The limited use standards for a self-service storage facility in the C9G downtown zoning district shall be as follows (if these standards are not met, the use is prohibited):

1.  The structure was constructed prior to March 20, 2015.

2.  The self-service storage facility is located only in the basement.

This ordinance also makes minor revisions to the use classification of indoor storage facilities and indoor wholesale and distribution facilities.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1.  Section 295-201-629 of the code is amended to read:

295-201.  Definitions.

629.  STORAGE FACILITY, INDOOR means an establishment providing indoor storage of materials, vehicles or goods.  This term does not include a >>self-service storage facility, a<< hazardous materials storage facility or an indoor wholesale and distribution facility.  This term includes, but is not limited to, [[a mini-warehouse or self-storage facility]] >>a moving company which might store personal or household items on a short-term basis, but does not include a business that consists largely of individual storage lockers or is self-service<< .

Part 2.  Section 295-201-632 of the code is created to read:

632.  STORAGE FACILITY, SELF-SERVICE means an enclosed storage facility having compartments, rooms, spaces, lockers or other types of units that are individually leased, rented, sold or otherwise contracted for the storage of personal or household property, where the storage areas are designed to allow private access to the units and the facility owner or operator has limited access to the units.  This term includes a mini-storage facility.  This term does not include an indoor storage facility or a wholesale and distribution facility.

Part 3.  Section 295-203-11-h of the code is amended to read:

295-203.  Use Definitions.

11.  STORAGE, RECYCLING AND WHOLESALE TRADE USES.

Part 4.  Section 295-203-11-i and j is renumbered 295-203-11-j and k.

Part 5.  Section 295-203-11-i of the code is created to read:

Part 6.  Table 295-403-2-a of the code is amended to read:

295-805.  Uses.

2.  LIMITED USE STANDARDS.

hh.  Wholesale and Distribution Facility, Indoor.  hh-1.  The gross floor area of the building devoted to storage as a principal use shall not exceed 3,600 square feet.

hh-2.  Storage of hazardous materials as described in s. 295-201-627 shall be prohibited.

Part 14.  Section 295-805-2-ii of the code is repealed and recreated to read:

ii.  Storage Facility, Indoor.  ii-1.  If the premises is located in an IC district:

ii-1-a.  The use is accessory to a permitted principal use or a use otherwise approved by the board, and located on the same premises as that use, or the use is located off-premises but is used in an accessory manner to a principal use located within 150 feet of the indoor storage facility and both premises are under the same ownership.

ii-1-b. If located on the first floor, the use is not located within 25 feet of the primary street façade of the building, regardless of whether the use is located on the same premises or a different premises than the principal use

ii-2.  If the premises is located in an IM district:

ii-2-a.  The gross floor area of the building devoted to storage as a principal use shall not exceed 3,600 square feet.

ii-2-b.  Storage of hazardous materials as described in s. 295-201-627 shall be prohibited.
