Analysis
This ordinance requires the department of city development to replace the non-utility owned portion of any lead drinking water service line serving a 1- to 4-unit, city-owned residential property prior to sale. Each replacement shall be performed by a city-certified small business enterprise contractor located in the city whenever possible.

Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 304-49-1-c to f of the code is renumbered 304-49-1-d to g.

Part 2. Section 304-49-1-c of the code is created to read:

304-49. Disposal of City Real Estate.

1. DEFINITIONS.

c. “Lead service line” means a conduit connecting a property to the water main designed to provide drinking water which is made entirely, or in part, including solder connections, of material containing more than 0.25% lead.

Part 3. Section 304-49-4.3 of the code is created to read:

4.3. NEIGHBORHOOD PROPERTY LEAD SERVICE LINE REPLACEMENT. The non-utility-owned portion of any lead service line serving a neighborhood property shall be replaced by the commissioner prior to sale. This replacement shall commence only after the commissioner has entered into a purchase agreement with a bona fide buyer and be completed before sale closing. The sale price of the property shall be greater than or equal to the cost to replace the lead service line serving the property. The commissioner shall use a city-certified small business enterprise contractor to perform each replacement whenever possible, but may use a contractor not certified as small business enterprise if no city-certified small business enterprise contractor is available within a reasonable period of time.
