Body
Whereas, Preliminary approval has been requested and received from the Wisconsin Department of Transportation, along with the Project Agreement to be executed by the City of Milwaukee, for the North Fratney / East Wright Bike Boulevards project under the 2016-2020 federal Transportation Alternatives Program; and
Whereas, The North Fratney / East Wright Bike Boulevards project will design and construct low-stress bicycle boulevards along North Fratney Street (East Keefe Avenue to East Meinecke Avenue) and East Wright Street (Oak Leaf Trail to North Palmer Street) to provide low stress, connected bicycling corridors in the Riverwest and Brewer’s Hill neighborhoods as shown in the attached map; and
Whereas, the Wisconsin Department of Transportation has submitted the Project Agreement for execution by the City of Milwaukee for the design of:

; and
Whereas, The State cannot proceed with any project cost overruns and changes in scope of more than 5% without prior Department of Public Works approval; and
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the Comptroller are authorized to execute the Project Agreement for the preliminary engineering of the aforementioned project with federal Transportation Alternatives Program funds, a copy of which is attached to and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the proper City of Milwaukee official is hereby directed to undertake preliminary engineering for the above-mentioned project, which is anticipated to begin in 2017, and to reimburse the Wisconsin Department of Transportation for preliminary engineering costs they incur for the improvements; and, be it
Further Resolved, That Department of Public Works shall request in a future resolution funding for the construction phase of the North Fratney / East Wright Bike Boulevards project under a Local Let Contract agreement; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for preliminary engineering for the project (expenditure) and transfer to any of these accounts the amount required under this grant agreement and City Accounting policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and the local share or $5,000, whichever is greater as follows:
