Resolution authorizing the proper City officers to execute a Quit Claim Deed (QCD-2861) document conveying combined sewers located in vacated North 38th Street between vacated West Linden Place and West Highland Boulevard to MillerCoors, LLC., and executing Sewer Easement (SE-2488) document in vacated West Linden Street between North 37th Street and vacated North 38th Street, in the 15th Aldermanic District.
Analysis
This resolution authorizes the proper City officers to execute a Quit Claim Deed (QCD-2861) document conveying the combined sewers located in vacated North 38th Street between vacated West Linden Place and West Highland Boulevard to MillerCoors, LLC. The sewers are being conveyed because they are no longer needed for public use. This resolution also authorizes the proper City officials to execute a Sewer Easement (SE-2488) document in vacated West Linden Street between North 37th Street and vacated North 38th Street. The Quit Claim Deed and the Sewer Easement are in the 15th Aldermanic District.

Whereas, In 1906, the City of Milwaukee constructed a 12-inch diameter and a 15-inch diameter combined sewer in North 38th Street between vacated West Linden Place and West Highland Boulevard; and
Whereas, Said North 38th Street was vacated on September 22, 2015 by Common Council File Number 150179; and
Whereas, The vacated lands are now part of MillerCoors, LLC; and
Whereas, Due to the vacation of a portion of North 38th Street, the combined sewers no longer serve the public interest; and
Whereas, MillerCoors, LLC has agreed to accept ownership of said sewers; and
Whereas, Said West Linden Street was vacated on September 20, 1988 by Common Council File Number 851462; and
Whereas, The City of Milwaukee has also requested an easement needed for sewer facilities in vacated West Linden Street between North 37th Street and vacated North 38th Street; and
Whereas, The easement area is in lands owned by MillerCoors, LLC; and
Whereas, MillerCoors is willing to grant Sewer Easement (SE-2488) to the City giving the City permission to enter the property to construct, operate, maintain, inspect, and repair, as City deems necessary, sewer facilities within the easement area on terms and conditions negotiated by the City’s Department of Public Works, as reflected in the easement document that has been made part of this file; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers, including the DPW Commissioner, are hereby authorized: (i) to sign the Quit Claim Deed (QCD-2861) and the Sewer Easement (SE-2488) documents, in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
