Title

Resolution relating to acceptance and funding of a Green Solutions grant from the Milwaukee Metropolitan Sewerage District for the installation of bioswales within the area of West Good Hope Road (CTH PP) between North 91st Street and North 107th Street in the 5th Aldermanic District and approving the construction of a nonassessable public improvement in said area.

 

Analysis

This resolution authorizes the Department of Public Works, Infrastructure Services Division, to accept and fund a Milwaukee Metropolitan Sewerage District Green Solutions grant with a maximum reimbursement amount of $207,258 for the construction of bioswales in the medians of West Good Hope Road (CTH PP) between North 91st Street and North 107th Street. The resolution also authorizes the Commissioner of Public Works to execute the Funding Agreement. The City cost of the project approved by this resolution is estimated to be $151,742. The total estimated cost is $359,000.

 

Body

Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) is responsible for collecting and treating wastewater from local sewerage systems; and

 

Whereas, Green infrastructure, such as bioswales, reduces the volume of stormwater in the sewer system and the amount of pollutants discharged to surface waters; and

 

Whereas, MMSD desires to promote the installation of green infrastructure and is willing to provide the City funding up to a maximum reimbursable amount of $207,258; and

 

Whereas, The City proposes to construct bioswales in the medians West Good Hope Road (CTH PP) between North 91st Street and North 107th Street; and

 

Whereas, Because said portion of West Good Hope Road is under the jurisdiction of the Milwaukee County (County), the City and the County will enter into an Agreement establishing the terms and conditions for the construction and maintenance of the bioswales; and

 

Whereas, The Agreement will also indicate that the City will retain ownership of the bioswales and of the associated facilities and that the City shall also receive the total amount of the Total Suspended Solids (TSS) reduction credits; and

 

Whereas, Said Agreement shall be introduced to the Common Council under a separate resolution; and

 

Whereas, Common Council File Number 151848 authorized the expenditure of $5,000 in preliminary engineering funds for the project; and

 

Whereas, Plans, specifications and cost estimates have been prepared for this project; and

 

Whereas, The Common Council has adopted a preliminary resolution determining it necessary and in the public interest to construct nonassessable improvements; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is authorized and directed to proceed with the construction of bioswales in the medians of West Good Hope Road (CTH PP) between North 91st Street and North 107th Street; and, be it

 

Further Resolved, That the Commissioner of Public Works is authorized to accept and execute the MMSD Green Solutions grant without further Common Council approval, unless the terms of the grant change as indicated in Common Council File 030712; and, be it

 

Further Resolved, That upon approval of this Agreement, the City Comptroller is authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project, and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:

; and, be it

 

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it

 

Further Resolved, That the Commissioner of Public Works is authorized to accept and execute the Green Solutions Funding Agreement between the City and the MMSD, a copy of which is attached hereto; and, be it

 

Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it

 

Further Resolved, That the Commissioner of Public Works, on behalf of the City of Milwaukee, is authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
