Title

Resolution authorizing the Chief Information Officer to share fiber and provide network connectivity at the expense of and for the use and benefit of the BloodCenter of Wisconsin.

 

Analysis

This resolution authorizes the Chief Information Officer to share fiber and provide network connectivity at the expense of and for the use and benefit of the BloodCenter of Wisconsin.  This will provide the BloodCenter of Wisconsin a direct connection between the BloodCenter of Wisconsin headquarters at 638 N 18th St and BloodCenter's Blood Research Institute located at the Milwaukee Regional Medical Center campus.

 

Body

Whereas, The City of Milwaukee wishes to enhance the health of individuals and families, as well as promote higher education and enhance educational resources in the community; and

 

Whereas, The BloodCenter of Wisconsin is a national leader in the education and development of the next generation of physicians and scientists, provides cutting-edge interdisciplinary and clinical care of the highest quality, and strives to improve the health of Milwaukee and surrounding communities; and

 

Whereas, The BloodCenter of Wisconsin has requested the assistance of the City of Milwaukee in obtaining direct network connectivity between their headquarters and the Blood Research Institute locations at its expense; and

 

Whereas, Common Council Resolution File Number 130594, adopted on September 24, 2013, authorized the Commissioner of Public Works to install fiber and provide network connectivity at the expense of and for the use and benefit of the BloodCenter of Wisconsin; and

 

Whereas, The City of Milwaukee owns dark fiber and can provide network services in certain routes that would be beneficial to the extension and enhancement of the BloodCenter of Wisconsin to further its mission even though the City cannot provide any customer service or connectivity guarantee for the use of that dark fiber; and

 

Whereas, It would be in the best interests of the City of Milwaukee to facilitate connectivity for the BloodCenter of Wisconsin in exchange for a nominal annual fee of $5,000 due to the location of the BloodCenter of Wisconsin’s Blood Research Institute outside of the City; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Chief Information Officer is authorized and directed to share dark fiber and to provide network connectivity at no cost to the City of Milwaukee in certain routes where capacity is available to enable the BloodCenter of Wisconsin to connect its headquarters and Blood Research Institute and, be it

 

Further Resolved, By the Common Council of the City of Milwaukee, that this Resolution is approved only on the condition that the BloodCenter of Wisconsin shall:

 

1.                     Prior to connection to the City’s dark fiber, and annually after connection, pay a $5,000 fee to the City to use the dark fiber; and

 

2.                     Have no expectation or demands for customer service or connectivity guarantees from the City for the BloodCenter’s use of the dark fiber; and

 

3.                     Waive any and all claims against the City and its employees related to the BloodCenter’s use of the City’s dark fiber, including, but not limited to, any damages suffered by the BloodCenter or others related to failure of the dark fiber or lack of connectivity regardless of the cause.
