Analysis

This ordinance provides that:

 

1.  An applicant for an ice cream peddler license, escort license, direct seller license or public passenger vehicle driver’s license shall be required to submit only one photograph of the applicant to the city clerk with the license application, rather than 2 photographs, as currently required.  Also, a photograph or other graphic representation shall no longer be required as part of an application for a pushcart.

 

2.  Consistent with provisions for other license types, no pawnbroker’s license or secondhand dealer’s license shall be issued unless the applicant has continuously resided in Wisconsin for at least 90 days prior to the date of application (the current requirement is one year).

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 68-43-3-d of the code is amended to read:

 

68-43.  Ice Cream Peddler License.

 

3.  APPLICATION.

 

d.  [[Two recent photographs]] >>One recent photograph<< suitable in size and form, as determined by the city clerk, for inclusion on the applicant’s official license.  [[One photograph shall be attached to the license when issued, and the other photograph shall be filed with the application with the city clerk.]]

 

Part 2.  Section 89-9-2 of the code is amended to read:

 

89-9.  Application for Escort License.

 

2.  APPLICATION.  Any person desiring an escort license shall file a written application with the city clerk on a form to be provided by the city clerk. Any applicant for an escort license shall furnish all information required by s. 89-7-2 as well as a description of the applicant's height, weight, color of eyes and color of hair. The applicant shall provide [[2]] >>one<< passport-size color [[photographs]] >>photograph<< at least one inch by one inch taken within 3 months of the date of application. In addition, the applicant shall identify by name and address the escort service at which the applicant is currently working, if any, or at which the applicant expects to be employed.

 

Part 3.  Section 92-1-5-b of the code is amended to read:

 

92-1.  Pawnbroker’s License.

 

5.  ISSUANCE; TERMS.

 

b.  No license shall be granted to any person who is not of good moral character and who has not resided in the state of Wisconsin continuously for a period of at least [[one year]] >>90 days<< prior to the date of filing an application, nor shall any such license be granted or issued to any person who has habitually been a petty law offender or has been convicted of an offense against the laws of the United States or any laws of this state punishable by imprisonment in the state prison or other penal institution as felonies unless the person so convicted has been duly pardoned, subject to s. 111.335, Wis. Stats.

 

Part 4.  Section 92-2-5-c of the code is amended to read:

 

92-2.  Secondhand Dealer’s License.

 

5.  ISSUANCE; TERMS.

 

c.  No secondhand dealer’s license shall be granted to any person who has not resided in the state of Wisconsin continuously for a period of at least [[one year]] >>90 days<< prior to the filing of his or her application.

 

Part 5.  Section 95-1-3-a-6 of the code is amended to read:

 

95-1.  Direct Sellers.

 

3.  APPLICATION.

 

a-6.  Size and description of the pushcart, stand, table, container or other stationary apparatus from which items will be sold.  [[A photograph or accurate graphic representation shall be included for pushcarts.]]

 

Part 6.  Section 95-1-3-c of the code is amended to read:

 

c.  Photograph of Applicant.  Each applicant for a license shall file with the application [[2 recent photographs]] >>one recent photograph suitable<< to the city clerk [[suitable]] for inclusion on the applicant’s official license.  [[One photograph shall be attached to the license when issued, and the other photograph shall be filed with the application with the city clerk.]]

 

Part 7.  Section 95-14-8-a of the code is amended to read:

 

95-14.  Home Improvement Contractor and Salesperson Licenses.

 

8.  ISSUANCE OF LICENSE.

 

a.  If the common council grants the application for a home improvement contractor or salesperson license, the city clerk shall issue an appropriate document to the applicant confirming that fact.  The license shall contain the person’s true first name, surname and middle initial, the picture of the applicant if individual [[or partnership]], the number of the license, the period of time for which the license is valid, and a statement that issuance of the license does not constitute an endorsement by the city of the person or product.  The license shall be in such form as to avoid alteration.

 

Part 8.  Section 100-54-3-b of the code is amended to read:

 

100-54.  Public Passenger Vehicle Driver’s License.

 

3.  APPLICATION.

 

b.  Each applicant for a driver’s license shall file with the application [[2 recent photographs]] >>one recent photograph<< suitable in size and form, as determined by the city clerk, for inclusion on the applicant’s official license.  [[One photograph shall be attached to the license when issued, and the other photograph shall be filed with the application with the city clerk.]]
