Title
Resolution approving a lease between the City of Milwaukee and the Wisconsin Center District for the North 4th Street pedestrian mall, in the 4th aldermanic district.
Analysis
This resolution authorizes a lease for a City pedestrian mall according to terms outlined in the Lease.
Body
Whereas, By passage of Ordinance File No. 151444, the Common Council of the City of Milwaukee created Section 113-21 of the Milwaukee Code of Ordinances to establish the North 4th Street pedestrian mall between West Juneau Avenue to West Highland Avenue, adjacent to the proposed new arena; and

Whereas, City staff negotiated the terms of a long-term lease, a copy of which is attached to this Common Council File, (“Lease”) with the Wisconsin Center District (the “District”) for the North 4th Street pedestrian mall (“Pedestrian Mall”) to allow the Pedestrian Mall to be developed into and used as a public plaza; and

Whereas, The Lease with the District permits the District to sublease the Pedestrian Mall to Deer District LLC, or its affiliate, under the same terms and conditions as contained in the Lease; and

Whereas, The Lease facilitates development and use of and activities on the Pedestrian Mall, ensures public access and transportation uses within the Pedestrian Mall and establishes operational and maintenance requirements to be the cost and responsibility of the lessee; and

Whereas, The Lease requires the design plans for the Pedestrian Mall to be approved by City’s Common Council before any improvements can be made to the Pedestrian Mall; and

Whereas, The Lease includes a number of triggering events the occurrence of which allow for the renegotiation of the Lease and the possibility of reopening North 4th Street to vehicular traffic in the future so long as the Pedestrian Mall is closed to vehicular traffic during events at the new arena so the Pedestrian Mall can be utilized for efficient and safe ing...
