All members present indicated that they had done so. The question was put: Are any of the following or their counsels present and, if so, do they wish to address the Common Council? Oliva A. Arias/Pablo De La Cruz were present by Attorney Francisco Aleman. James Heyden was present by counsel, Attorney E. Michael Guerin;. Margaret E. Flynn was not present. Ald. Bohl moved that the Common Council resolve itself into a Committee of the Whole for the purpose of taking testimony in these matters. There was no objection. Minutes note: 14 SINGH, Parshotam, Class “A” Malt application for “A K Food Mart” at 2305 S. Howell Avenue. New Location Appliant at the table, 2305 S. Howell Ave., with Michael Maistelman as counsel. Ald. Zielinski at the table. Mr. Maistelman says that the issue is really gentrification of the area, not any problems with the location. He also presents blue prints and plans for improvement of the location and presents the applicant's plans to build on a vacant lot owned by the applicant. Ald. Hamilton moves to make the check from Tri-City National bank dated January 31, 2007 part of the record (Exhibit 1). Prevailed 3-0. (Ald. Coggs and Ald. Zielinski excused) Ald. She says that the business does not enhance walkability or maintain historical integrity of the area. Mr. Maistelman asks Ms. Tornes if she knows what kinds of people live in a nearby apartment complex. Ms. Tornes says that she believes that they are low income and needing of services. Jenny Taylor-McBride, 2212 S. Austin St., about two blocks away from the store. She is not in support of the license. She says that she does not feel comfortable walking in the area due to loitering and people who are publicly intoxicated loitering in the area. Meeting recessed at 11:15 a.m. Meeting reconvened at 11: 19 a.m. Cameryne Roberts, owns Cafe LuLu at 2265 S. Howell Ave. She says that there is public drunkeness, public urination and panhandling in the area that she believes is a result of cheap beer being accessible in the area. Ms. Roberts says that she has to pick up beer cans from her property and she also says that she has seen a woman sitting on her front business steps urinating with a beer can next to her. Ms. Roberts acknowledges that the beer is coming from another outlet, but she says that she would like to see less access to beer in the area. Mr. Maistelman asks Ms. Roberts what she has seen in front of Mr. Singh's establishment. Ms. Roberts says that she has seen panhandling and loitering in front of Mr. Singh's establishment. Sarah Jonas, co-owner of Cafe LuLu, is not in favor of the license. She says that when she comes to work at 8:00 a.m., she sees people urinating publicly. Mr. Maistelman asks if Ms. Jonas has called the police when she sees loitering. Ms. Jonas says that she had a customer who said they were being harrassed as they were walking to her establishment. Ms. Jonas says she called police after this incident. Stephanie Harling, 1318 E. Seeley St., maintains the community beautification project close to the establishment. She says that she has seen people being harrassed and has seen panhandling by people who loiter in front of AK Food Mart. She says that a beer license would not be good for the economic future of the area. Matt Freeman, 2242 S. Kinnickinnic Ave., operates Jimmy John's on Kinnickinnic Ave. Says that the establishment is an eyesore. He is opposed to the license. Mr. Maistelman asks if Mr. Freeman has seen problem people coming in and out of the the AK Food Mart. Mr. Freeman says no. Erica Zitzke, 2246 S. Robinson Ave., one block away from the establishment. Ms. Zitzke says that she is opposed to the license. Daniel Lee, owner of buildings at 2306-18 S. Kinnickinnic and 441 E. Lincoln Ave. He is in opposition to the license. He says that graffitti can be a problem in the area, but that he takes prompt action removing graffitti when his building is tagged with it. Ken Yandell, owns several buildings on Kinnickinnic Ave, including 2242-46 S. Kinnickinnic Ave. Is opposed to the alcohol license because he thinks it is bad for the area. He says he has witnessed loitering, panhandling and public urinating in the area of AK Food Mart. Jill San Augustin, 2211 S. Robinson Ave., is opposed to the license. She says that she has had to remove beer cans from her yard. She also says that she was propositioned for sex on two occasions on the corner of Howell and Lincoln. She says that the area does not need any cheap alcohol. Mr. Maistelman asks if Ms. San Augustin has witnessed illegal activities at the applicant's store. Ms. San Agustin says that she has witnessed loitering and a fight in front of the establishment. Krystian Sydow, has an office at 347 E. Lincoln Ave. and owns 2254-64 S. Kinnickinnic Ave. He says that he has seen customers from AK Food Mart engaging in illegal activity, including prostitution. Arlene Jorgensen, Legislative Aide to Ald. Zielinski, at the table. She says that she took a photo from the sidewalk showing milk crates on the side of the applicant's store. Bill Doyle, 3042 S. Wentworth Ave., owns buildings on Kinnickinnic Ave. He says that he has called the police on various occasions and has spoken to local officers about the problems in the area of AK Food Mart. He says that the neighborhood improves whenever a liquor establishment is closed and a new alcohol license is not good for the neighborhood. Timothy Durtz, has an office at 347 E. Lincoln Ave. He says that he has had to remove a drunk person from the back of his apartment complex and that he has had to repair his fence repeatedly when underage people cut through his property to shop at AK Food Mart. Mr. Maistelman asks Mr. Durtz if he has ever asked the applicant about buying the applicant's property. Mr. Durtz says that he has talked with Ald. Zielinski about buying the the applicant's property if it ever became available. Jason Fox, business partner of Mr. Durtz. He has seen people loitering in the empty lot adjacent to the business and owned by the applicant. Bob Danowski, 2639 S. Kinnickinnic Ave. Is opposed to the license. Michael Maierle, urban planner with the Department of City Development. He says that the business does not fit in with the Comprehensive Business Plan for the area. Ald. Hamilton asks if Mr. Maierle has had the opportunity to see the plans submitted by the applicant for his business and if it fits into the plan. Mr. Maierle says that he has not seen the plans. Ald. Bohl asks if issues with regards to economic development fit into what was noticed as possible reasons for denial. Mr. Schrimpf says it is up to the discretion of the Chair, but the testimony could be received as bearing on concentration of outlets and welfare of the neighborhood. Susan Davey, 1124 E. Dakota St., about a mile away; she says that she walks by the area of AK Food Mart even though she lives a mile away. She is opposed to the license and says that she sees the vagrancy in the neighborhood and it frightens her. She says she has been approached in a lewd way. She also says that she is a senior on a fixed income and wants to live in a safe neighborhood. Jackie Block, 3116 S. Quincy Ave., block watch captain with Humboldt Park South Block Watch. Is opposed to the license. Supporters: Dagoberto Ibarra, 2925 W. National Ave., is in support of the license. He thinks that the opposition to the license is a race issue. Bajwa, lives in Germantown. He is personal friends with the applicant. He says that the applicant has owned the store for twenty years and just wants to add beer sales. Mr. Bajwa also says he does not see anything wrong with the applicant getting more business with a beer license. David J. Saldivar, 2325 S. Howell Ave. He thinks that economically, having a beer license at the AK Food Mart is a good idea. Ald. Zielinski asks if Mr. Saldivar will buy beer from the the AK Food Mart if it receives the beer license. Mr. Saldivar says yes. Ald. Bohl asks if Mr. Saldivar buys beer from the other convenience store in the area. Mr. Saldivar says no. John Shelton, 2302 S. Howell Ave., tenant of the applicant. Mr. Shelton says that loitering and panhandling is happening all over the area and that it is not fair to point just to the AK Food Mart as having loiterers. Is in support of the license. Singh Kaleka, he doesn't think that the alderman should be opposed to the beer license and is in support of the license. Diane Semanko, 2325 S. Howell Ave., says that the services that the store provides are an asset to the community. She says that beer would be another asset added to the store and that panhandlers outside the store is not the problem of the applicant. Ms. Semanko believes that the applicant takes care of the inside of the store and that people will get alcohol one way or another. Denise Schlieve, 1943 S. 12th St., used to live in the Bayview area and still frequents AK Food Mart about four days a week. She says that she never sees the problems outside of the AK Food Mart. She is in support of the license. Patricia Poe, 345 E. Smith St., goes go the store everyday. Is in support of the license. Frye, 2508 S. Burrell St., says she has no complaints about the AK Food Mart, although she admits that the area has some problems. She says that loitering is everywhere, not just at AK Food Mart and shouldn't be blamed on the applicant's store. Julie Howard, lives in Cudahy but previously lived in Bayview for fifteen years. She says that she is in support of the license because it would allow the applicant to expand his business. Ald. Zielinski says that two neighborhood supporters that were present at the last hearing for the application gave an address of a home that Ald. Zielinski says is known to police as a source of drug activity. Ald. Bohl says that the testimony of a police officer to this is not necessary to hear in regard to the license application. Ald. Zielinski says that the applicant testified that he is unaware of graffitti and improper storage on his property, which shows that he is not a responsible property owner. He also said that a beer license for the store would not be good for the area. Mr. Maistelman says that opponents are actually trying to close down the low-income apartment complex by the store and that the opposition is about a bigger issue. Mr. Singh says that he has never been contacted by the police or anyone else regarding the problems with loitering or any other illegal activity at his store. Ald. Zielinski requests that a Department of Neighborhood Services report for 2301 S. Howell Ave. be entered into the record. The committee members refuse to move to make the report part of the record (Rejected Exhibit 1). Ald. Kovac moves to deny based on the issue of concentration of alcohol beverage outlets in the area. So he doesn't believe that the problems that occur at the establishment have to happen at alcohol establishments. Andrew Legault, 1437 W. Arthur Ave., says that the noise in the neighborhood is getting worse. He has to pick up trash out of his yard three or four times a week. He says that the trash has improved since the bar closed. Dawn Palma, 2487 S. 15th St., says that people urinate in front of her house and beer bottles are thrown over the wall in front of her house. Ms. Palma says that at least twice during the time that the bar was supposed to be closed people could be seen in the bar. She did not call the police when she saw this because she says that she has been threatened by the patrons of the bar for trying to get it closed. Kevin Sinnen, 1436 W. Arthur Ave., has lived in the area since January of 2008. He is opposed to the license. Mr. Sinnen says that Friday nights and Saturday nights are the problem nights with screaming and yelling outside the bar. Mr. Smith asks if Mr. Sinnen has seen any cars parked outside of the bar Toni Sinnen, 1436 W. Arthur Ave., has the same complaints as her husband. She is still woken up by the noise even though there is soundproofing in the part of the church parsonage where she lives. Supporters: Jose Rios, 2440 S. 14th St., a block away from the establishment. He says that he goes to the bar all the time. Mr. Rios says that he never sees the problems at the bar, but he has heard gunshots and heard squealing tires even when the bar is closed, so the bar shouldn't be blamed. He also says that the jukebox is on low volume in the bar. Mr. Smith asks if he has ever seen a fight at the bar. Mr. Rios says no. Barbara Hernandez, 3919 S. 76th St., used to live at 2581 S. 15th St., but recently moved out of the neighborhood. She says that she brought the DJ to the establishment on the weekends, but says that she told the DJ about the rules of the bar and helps the DJ get out of the bar by 2:30 a.m. Ms. Hernandez says that people over 25 go to the establishment and that she alerts the applicant to problems in the bar, which they take care of. Ines Perez, 2606 S. 13th St., has been going to the bar for three years and has not seen any problems. Sharon Herriges, 6425 S. Norwich Ave., Greenfield. She says that her daughter lives by the bar, and she says that she has never heard any loud music or seen any problems. She has been a patron there at times. Juan Herrejon, security officer for Central Protective Services, says that his company has taken over the security for the business and that there have not been any problems since they took over the security. Mr. Smith asks if anything has been confiscated by security at the bar, and Mr. Herrejon says no. Ald. Witkowiak says that he met with the applicant, but they did not discuss the issue of problems spilling out into the neighborhood. He says that the bar owners are good people and if the establishment were located on a commercial strip there probably would not be complaints. Ald. Witkowiak says that the establishment is on a corner in an area that is quiet and densely populated and that it does not fit in the neighborhood as it has been operated. Mr. Smith asks Mr. Molinari if anyone has ever been cited or arrested in the bar, and Mr. Molinari says no. Mr. Smith says that Mr. Molinari has operated the bar in a law-abiding way. Ald.
