Minutes note: 14 SINGH, Parshotam, Class “A” Malt application for “AK Food Mart” at 2305 S. Howell Avenue. New Location Special Letter Applicant at the table. Michael Maistelman, counsel for the applicant, also at the table, as is Ald. Zielinski. Mr. Maistelman says that the objections are not substantiated by any materials in the license file. The applicant says that the license is for selling beer only. Neighborhood objectors present: Kelly Durian, 2211 S. Robinson Ave., has personally witnessed excessive littering and has consistently seen groups of people loitering outside the establishment. Charles Stamschorr, 2571 S. Brisbane Ave., has personally witnessed an individual around the premises who was picking up used cigarette butts, another individual was mumbling and individuals that are often loitering in front of the premises. He does not shop there, as he is not comfortable with the environment around the business. Vera Pawlak, 902 E. Homer St., four blocks away, says passes the location everyday. She says that she sees loitering when she is coming home from work and sees cars parked to the end of the intersection, which makes it hard to see. Ms. Pawlak says she sees loud men loitering around the establishment and that the store is dirty and unkempt. She says that the neighborhood does not need another alcohol outlet. Ms. Pawlak says she sees less loitering when she passes the location in the morning around 8:45 a.m. Meeting recess at 3:33 p.m. Meeting reconvened at 3:48 p.m. Waldek Duinerman, owns 2379 S. Howell Ave, within the block of the establishment. He used to live in the area and also works in the area. He has traveled the block twice or more times a day, five to seven days a week for seven years. He says he sees a noticeable amount of loitering in front of the store spilling out to an empty lot and cars being double-parked so people can go into the store. He sees about two to four people at a time hanging out in front of the business. He also does his banking at the Maritime Bank next door. Mr. Duinerman says there used to be what he believed to be a drug dealer who used to hang around the location and around his property, which he reported to the police. He says that there is already a store that sells beer twenty feet away. Chris Allen, 2525 S. Brisbane Ave., four blocks away from the business, Safety Chair of the Bayview Neighborhood Association. Formed a block watch program. He says that he has seen public intoxication and loitering and he admits that the problems are coming from three different convenience stores, not just the business in question. He says he sees problems in front of AK Food Mart everyday. Mr. Allen says that the proprietors of all three convenience stores in the area were invited to a block watch meeting and no one from any of the establishments attended. Neighborhood supporters: Joseph Koch, 2325 S. Howell Ave. #1204, president of the Lincoln Court Resident Organization. He says that Mr. Singh has been cooperative in dealing with parking problems that are brought to his attention and that he is a good businessperson. Mr. Koch also says that what he sees out in front of the store he wouldn't describe as loitering. He also says that he helped clean up a vacant lot in the area and put up a fence. Mr. Koch says that Mr. Singh is a good neighbor and should not be denied a business opportunity. He also says that for convenience items, he shops at Mr. Singh's store. He also says that he has not witnessed any of the problems listed in the neighborhood notice and that crime, including vandalism, is going down. Valerie Keiller, 2149 S. Woodward, three blocks from the store, says she can make a healthy meal from things bought at the store. She says that she is there everyday at 6 a.m. to catch the bus to work. Ms. Keiller says a convenience store is needed and that she would like to be able to get her beer at the same location while she is buying groceries. She says she sees none of the issues that are listed on the notice (littering, loitering, prostitution, etc.). Julio Mayorca, 4736 Harbor Dr., IL, former manager at Maritime Bank. He believes that Mr. Singh is not a bad businessperson. He also says that loitering is in various areas of the neighborhood and it is unfair for blame to be put on one person, Mr. Singh. Says he disagrees that the problems listed in the neighborhood notice occur at the establishment. Robin S. Barnes, 2345 S. Howell Ave., has lived two doors down from the business for 19 years. He says that he has never felt threatened at AK and has never seen the problems detailed in the notice at the location. He also says that he doesn't see how the liquor license would be detrimental to the community. William Anders, 2810 E. Edgerton Ave., stops two or three times a week after working from downtown. He says he has not seen any of the illegal activity detailed in the notice and thinks the license would be an asset. Georgia Lee, 2810 E. Edgerton Ave, Cudahy. She says that she used to live in the area and still frequents AK. She says that she has not noticed any illegal activity and does not think the license would be detrimental. Tom Piech, 5424 S. 21st St., says he has been in the store once a week for the last eight years. He would support the applicant getting the license and has not seen any illegal activity. Daniel Schodeberg, 1849 W. Greenfield Ave., says that the applicant has a full variety of groceries and thinks that the liquor license would add to the business and not add any trouble to the neighborhood. He says he visits the establishment about fourteen times a month and never sees illegal activity. Matthew Johnson, 2325 S. Howell Ave. #1207, says he has not really seen loitering at the location and competition would be good for the neighborhood. Kathleen Hoffmann, 2325 S. Howell Ave., says she has not seen any loitering at the location. She says what is one more store in the neighborhood selling alcohol. She also says that she has not seen any double parking. Jeff Heppert, business owner at 1223 W. National Ave. He says that he visits the business weekly or bi-weekly. He thinks the license will allow the applicant to be competitive and stay in the neighborhood. David Furst, 2325 S. Howell Ave., has lived there 15 years and visits the establishment everyday. He supports the applicant having the beer license and has not seen any illegal activity at the establishment. Diane Samenko, 2325 S. Howell Ave. #206, says she doesn't see a reason why the applicant should not receive a liquor license. She says that she has lived in the area for ten years and has not seen any of the illegal activity listed in the notice at the establishment. Meeting recessed at 5:29 p.m. Meeting reconvened at 5:36 p.m. George Henning, 740 N. Linus, two and a half blocks away from the store for about four years. Says he has not seen the problems listed in the notice at the establishment and that the applicant getting a license would be an asset to the community. Edward Williams, 2337 S. Kinnickinnic Ave, for about 12 years. Says he does not see why the applicant should not get a liquor license and that he does not see any illegal activity at the location. He also says that he goes in the store sometimes four or five times a day. Joanne Iacono, 2149 S. Woodward, has lived there over thirty years, is not opposed to the applicant receiving the license and says that the location is convenient for her. She does not think it would be detrimental to the neighborhood. Brenda Silva, 1535 S. 2nd St., has lived at the address for 28 years. She says it would be more convenient to go to the establishment for beer instead of crossing the street to go to another establishment. She also says that the liquor license would Ethel Pfapp, 150 E. Juneau #305, says that she goes to the establishment three times a month. Would support the licensee receiving a license. Joan Nelson, 2345 S. Howell Ave. #105, lives about three houses away from the establishment. She says she agrees with the supportive testimony and has never seen any loitering in front of the establishment. Francis Heidenreich, 2345 S. Howell Ave., says he would prefer to go to just one store for all his needs, including beer. He says he has seen double parking, but when Mr. Heidenreich sees loitering he tells the applicant and the applicant takes care of it. David Nuetzel, 2147 S. Winchester, about two and a half blocks away, agrees with the supportive testimony. He does see occasional panhandlers, but does not see any other illegal activity at the location. Mr. Singh says that his business cannot survive without the beer license. He also says that he has wanted to have a liquor license for four years. Ald. Zielinski says that the establishment having a beer license is not good for the neighborhood. He also says that there are ten other locations where alcohol can be purchased in the area. Ald. Kovac moves to make the one-mile radius concentration map dated October 1, 2008 centered on 2305 S. Howell Ave. part of the record. Prevailed 3-0. (Alds. Hamilton and Zielinski excused) Ald. Puente points out that Ald. Zielinski said he would support the license if the applicant did something different with the location, so he thinks that Ald. Zielinski's opposition is not really about concentration. Ald. Puente moves to grant despite items contained in the notice Prevailed 2-1. (Ald. Kovac voting "no" and Alds. Puente asks Ald. Bauman if the police department regularly reserves police resources to deal with the club. Ald. Bauman says he believes so. Ald. Zielinski says that the applicant is not saying the business will do anything differently to prevent things from happening. The applicant says that situations occur that do not appear on the police report because they are handled professionally and prevented before they become problems. Mr. Manjee says that more people are being hired and have been hired since May and that the business works with the police department by letting them know when the crowd will be let out of the building. Mr. Manjee also says that in the summer they stopped serving alcohol early, about 1:45 a.m. Mr. Murado says that most of the patrons park at the corner of Broadway and Michigan. For underage parties on Friday nights, the closing time is midnight. He says that some underage persons leave the club and loiter in parking lots after closing time. She says that she spent time at her current address before the establishment opened in 2004, and she says that the incidents did not happen before the club opened. He also says that a dog is used on occasion for security. Ms. Jungers says that most of the problems occur on teen nights. Ald. Bauman says that problems have been shown to occur in the area of Broadway and Michigan, which is where Mr. Murado says that patrons park. He recommends non-renewal. Ald. Zielinski moves for a 45 day suspension based on items on the police report and neighborhood objections. Prevailed 3-1. (Ald. Bohl voting "no" and Ald. Hamilton excused) Ald.
