Analysis
This resolution authorizes the Director of the Milwaukee Public Library to execute a 10-year Limited Term Conservation Easement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District. The easement requires the City to keep, preserve and maintain green infrastructure at the Tippecanoe Library, 3912 South Howell Avenue.
Body
Whereas, Stormwater pollution control is an important component of the City of Milwaukee’s (“City”) stormwater management regulations and the City’s stormwater permit with the Wisconsin Department of Natural Resources; and

Whereas, Nonporous areas such as parking lots have been recognized as a significant source of environmental pollution by discharging polluted runoff directly into the local streams and water bodies, threatening natural habitat and species; and

Whereas, In 2015, the Milwaukee Public Library was awarded a Green Infrastructure Partnership Program Grant from the Milwaukee Metropolitan Sewerage District (“MMSD”); and

Whereas, The grant funds allowed green infrastructure consisting of permeable pavement, bioswales and native landscaping to be installed at the Tippecanoe Library site; and

Whereas, The funding agreement for said grant stipulated that in order for MMSD to reimburse the City for the cost of the project, the City shall execute a maintenance covenant in favor of MMSD; and

Whereas, MMSD has drafted such Limited Term Conservation Easement, a copy of which is attached to this Common Council File, that shall be in effect for a period of ten years;...
