Resolution relative to the cost participation and installation of permanent street lighting in conjunction with the Federal/State Aid paving of North 76th Street from West Clinton Avenue to West County Line Road in the 9th Aldermanic District at a total estimated cost of $346,272.26, which is 100% State funded.
Analysis
This resolution authorizes the Commissioner of Public Works and the Comptroller to enter into a funding agreement with the Wisconsin Department of Transportation (WISDOT) for installation of permanent street lighting in conjunction with the paving of North 76th Street from West Clinton Avenue to West County Line Road in the 9th Aldermanic District. The total estimated cost is $346,272.26, which is 100% State funded. This resolution also authorizes the Comptroller to establish and transfer funds to the appropriate accounts for the project and the Commissioner of Public Works to install permanent street lighting improvements.
BODY
Whereas, The Wisconsin Department of Transportation (WISDOT) is paving North 76th Street from West Clinton Avenue to West County Line Road; and
Whereas, The Common Council has previously approved file number 041385, which authorized the Commissioner of Public Works and the Comptroller to enter into a project agreement with the WISDOT for engineering and construction of North 76th Street from West Clinton Avenue to West County Line Road; and
Whereas, The WISDOT has determined that they will operate and maintain the street lighting on North 76th Street at intersections where they operate and maintain traffic signals within the project limits, including West Calumet Road, West Tower Avenue, West Bradley Road, West Dean Road, West Brown Deer Road, Private access road to Granville Station, West Northridge Lakes Boulevard and West County Line Road; and
Whereas, The Department of Public Works (DPW) will operate and maintain street lighting on all remaining portions of North 76th Street from West Clinton Avenue to West County Line Road other than at the signalized intersections; and
Whereas, The total estimated cost of this project is $346,272.26 for the installation of permanent street lighting; and
Whereas, One hundred percent of the participating project cost, or $346,272.26, is reimbursable from the WISDOT, and this amount is not included in Division accounts, and should be earmarked for this project in the 2008 Capital Grant and Aids Projects Fund Project/Grant Number SP032080100; and
Whereas, WISDOT cannot proceed with any project cost overruns and/or changes in scope of more than five percent without prior Department of Public Works approval; and
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and/or changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the WISDOT should the City decide to withdraw from the project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and Comptroller are authorized to enter into a funding agreement and are directed to execute the contract with WISDOT for the installation of permanent street lighting facilities in conjunction with the improvements to North 76th Street from West Clinton Avenue to West County Line Road with LFA prices based on a predetermined estimate prepared under the Federal/State aided highway program, a copy of which is attached to this resolution, and is incorporated into this resolution as though set forth in full; and, be it
Further Resolved, That upon approval of this contract, the Commissioner of Public Works is directed to install permanent street lighting facilities in conjunction with the paving of North 76th Street from West Clinton Avenue to West County Line Road; and, be it
Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater as follows:
