Analysis

This resolution directs the Intergovernmental Relations Division - Department of Administration to seek introduction of state legislation to allow for the towing/booting and impounding of vehicles for unpaid parking citations and refusal to release the vehicles until all outstanding citations are paid or adjudicated. This language is permissive whereby a city may tow or boot a legally parked or illegally parked vehicle for unpaid parking citations and hold the vehicle until citations are paid.

Whereas, The City of Milwaukee’s Outstanding Debt Task Force was created by Common Council File Number 041446 on April 12, 2005, to evaluate and make recommendations relating to procedures for collecting delinquent taxes, forfeitures, judgments and fees owed to the City of Milwaukee; and

 

Whereas, The City of Milwaukee’s Outstanding Debt Task Force submitted its final report and recommendations to the Common Council on December 13, 2005; and

 

Whereas, The Outstanding Debt Force’s final report’s recommendations included directing  the Intergovernmental Relations Division- Department of Administration to seek passage of state legislation to allow for the towing/booting and impounding of vehicles for unpaid parking citations and refusal to release the vehicles until all outstanding citations are paid or adjudicated; and

 

Whereas, On January 18, 2006, the Common Council adopted Common Council File Number 051150, a resolution that directed the Intergovernmental Relations Division- Department of Administration to seek passage of state legislation to allow for the towing/booting and impounding of vehicles for unpaid parking citations and refusal to release the vehicles until all outstanding citations are paid or adjudicated; and

 

Whereas, The Wisconsin State Legislature included the vehicle towing/booting legislation the City sought as part of the 2008-09 State of Wisconsin Budget bill; and

 

Whereas, Subsequently, Governor Doyle vetoed that portion of the 2008-09 State of Wisconsin Budget bill pertaining to the towing/booting of vehicles; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Intergovernmental Relations Division- Department of Administration is directed to seek introduction and passage of permissive state legislation that allows jurisdictions to enact legislation relating to the towing/booting and impounding of vehicles for unpaid parking citations and refusal to release the vehicles until all outstanding citations are paid or adjudicated.
