Analysis
This ordinance exempts a food manufacturer or distributor from the requirement to obtain a city food dealer license if the business derives 25% or more of its gross sales from wholesale or distribution business, has obtained appropriate licensing from the state, and does not serve meals to the public.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 68-21-2-e and f of the code is created to read:
68-21. Food Dealer License.
2. LICENSE NOT REQUIRED.
e. A food manufacturer that derives 25% or more of its gross sales from wholesale trade, has obtained a food processing plant license from the state, and does not serve meals to the public.
f. A food distributor that derives 25% or more of its gross sales from wholesale trade, has obtained a food warehouse license from the state, and does not serve meals to the public.
