Resolution authorizing the City Attorney to litigate to oppose the request of U.S. Venture, Inc. to have its property in the city of Milwaukee classified as manufacturing property.
Analysis
This resolution authorizes the City Attorney to file papers to intervene or otherwise become a party in the litigation pending before the Wisconsin Tax Appeals Commission, Case Number 15-M-185, and to oppose the request of U.S. Venture, Inc. to have its property in the city of Milwaukee classified as manufacturing property.
Body
Whereas, U.S. Venture, Inc. owns certain oil terminals in the city of Milwaukee and against which certain assessments have been made; and
Whereas, U.S. Venture, Inc. made a request to the Wisconsin Department of Revenue (WDOR) to classify its property in the city as manufacturing property pursuant to s. 70.995, Wis. Stats.; and
Whereas, The WDOR denied this request; and
Whereas, U.S. Venture, Inc. appealed the WDOR’s determination to the Wisconsin Tax Appeals Commission on October 12, 2015; and
Whereas, There is a potential for negative financial impact to the City of Milwaukee if the property is classified as manufacturing property; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the City Attorney is authorized to file papers to intervene or otherwise become a party in the litigation pending before the Wisconsin Tax Appeals Commission, Case Number 15-M-185, and to oppose the request of U.S. Venture, Inc. to have its property in the city of Milwaukee classified as manufacturing property.
