This resolution terminates Business Improvement District No. 29 (Atkinson, Capitol and Teutonia).

...Body

Whereas, On November 6, 2002, the Common Council adopted File Number 020831, a resolution creating Business Improvement District No. 29 (Atkinson, Capitol and Teutonia); and

Whereas, The Common Council finds that BID No. 29 should be terminated due to the dormant nature of the BID’s operations, the lack of communication by the BID manager and the BID’s failure to complete activities in its annual operating plan; and

Whereas, The Common Council further finds that BID No. 29 lacks the statutorily-required number of board members, has failed to provide required annual audits, and has failed to submit minutes of its board meetings to the City’s Legislative Reference Bureau; and

Whereas, The Common Council is not confident that BID No. 29 is using its BID special assessment revenues for the purposes intended; and

Whereas, Section 66.1109(5)(b), Wis. Stats., provides that a municipality may terminate a business improvement district at any time; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Business Improvement District No. 29 (Atkinson, Capitol and Teutonia) is terminated; and, be it

 

Further Resolved, That, pursuant to s. 66.1109(4), Wis. Stats., the proper City officials are authorized and directed to return all special assessments collected by the City and remaining in the Business Improvement District No. 29 account to the owners of specially-assessed property in the District, in the same proportion as the last collected special assessment.
