Title:
Sustitute resolution approving a lease between the City of Milwaukee and New Cingular Wireless PCS, LLC, for a portion of the parcel located at 3929 S. 6th Street, in the 13th Aldermanic District.
Analysis:
This resolution approves a lease agreement with New Cingular Wireless PCS, LLC for a portion of the parcel located at 3929 S. 6th Street (Milwaukee Water Works facility known as the Howard Avenue Water Treatment Plant) on which a new monopole will be constructed.
Body:
Whereas, New Cingular Wireless PCS, LLC (“New Cingular”) previously had its personal communications services antennas located on the Robert A. Anderson Municipal Building (the “Municipal Building”); and
Whereas, These antennas were removed from the Municipal Building and temporary facilities are in place in the parking lot of the Municipal Building; and
Whereas, New Cingular and the City of Milwaukee worked together to identify a new, mutually acceptable, permanent location for New Cingular’s antennas, which resulted in the southwest corner of the Howard Avenue Water Treatment Plant property being selected; and
Whereas, The City through the City Attorney's Office negotiated a lease agreement with New Cingular for the lease of a portion of the Howard Avenue Water Treatment Plant property, the construction of a 190-foot monopole, and the placement of personal communications services (PCS) antennas; and
Whereas, The lease agreement offers a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves the "Land Lease Agreement," between the City of Milwaukee and New Cingular Wireless PCS, a copy of which is attached to this file, and authorizes the proper City officials to enter into this lease on behalf of the City of Milwaukee
