Title
Resolution authorizing the Commissioner of Public Works to execute a Memorandum of Understanding between the City of Milwaukee and Milwaukee County to undertake joint stormwater Best Management Practices in the area west of the Menomonee River Parkway to meet the requirements of the Menomonee River Group Watershed Based Permit, in the City of Wauwatosa and in the 5th Aldermanic District.
Analysis
This resolution authorizes the Commissioner of Public Works to execute a Memorandum of Understanding between the City of Milwaukee and Milwaukee County to undertake joint stormwater Best Management Practices as required by the Menomonee River Group Watershed Based Permit. The Best Management Practices will be included as part of Milwaukee County’s roadway reconstruction project of the Menomonee River Parkway, located on the east side of the Menomonee River and borders the City of Milwaukee and the City of Wauwatosa.
Body
Whereas, The City of Milwaukee (City) and Milwaukee County (County) are two of eleven co-permittees of a watershed based stormwater discharge permit known as the Menomonee River Group Watershed Based Permit (Permit) issued to all permittees by the Wisconsin Department of Natural Resources (WDNR); and
Whereas, The permit requires that the all permittees pursue and implement a joint project (Joint Project) prior to the end of the term of the current permit or December 31, 2017; and
Whereas, Milwaukee County is currently in the process of reconstructing the Menomonee River Parkway (MRP), which is located on the east side of the Menomonee River and borders the City of Milwaukee and the City of Wauwatosa; and
Whereas, The roadway reconstruction will include certain storm water best management practices (BMPs) as part of the base design in order to satisfy project-specific permit needs, however, additional BMPs could be added to serve as the Joint Project; and
Whereas, The City and the County believe that the inclusion of additional BMPs consisting of the installation of five bioswales on the west side of the MRP could satisfy the Joint Project requirement; and
Whereas, The City and the County agreed to share in the cost of the Joint Project elements and the County has prepared a Memorandum of Understanding (MOU) stipulating the responsibilities between the City and the County; and
Whereas, The Municipalities of Greenfield, Wauwatosa, and West Allis have expressed interest in participating in the Joint Project and have agreed to share in the cost of the Joint Project under separate Memoranda of Understanding; and
Whereas, The total cost of the Joint Project is approximately $92,000, of which the City share is $30,000 and has been authorized for project SM499150108 per Common Council Resolution File Number 150617; and
Whereas, Any storm water pollution discharge credits that are generated as a result of the Joint Project shall be shared by the City and County, as well as other participating co-permittees, in direct proportion to their relative cost share; and
Whereas, The shared cost of the BMPs shall also include their maintenance for the first two years after completion of the Joint Project and that the County shall be solely responsible for maintenance thereafter; now therefore, be it
Resolved, That the Commissioner of Public Works is authorized to execute a Memorandum of Understanding between the City of Milwaukee and Milwaukee County to undertake joint stormwater Best Management Practices in the area west of the Menomonee River Parkway to meet the requirements of the Menomonee River Group Watershed Based Permit, said MOU being attached to this Common Council Resolution File Number 150880 and is incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That minor changes to the draft MOU which do not change the intent of the agreement are hereby approved.
