Analysis

This ordinance creates an original domicile restriction under which no person who has been convicted of a sexually violent offense or a crime against a child shall be permitted to reside in the city, unless such person was residing in the city at the time of the offense resulting in the person's most recent conviction for committing the sexually violent offense or crime against a child.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 106-51-5 of the code renumbered 106-51-6.

 

Part 2.  Section 106-51-5 of the code is created to read:

 

106-51. Residency Restrictions for Sex Offenders.

 

5. Original Domicile Restriction. In addition to the restrictions of sub. 3, but subject to sub. 4, no person who has been convicted of a sexually violent offense or a crime against a child shall be permitted to reside in the city, unless such person was domiciled in the city at the time of the offense resulting in the person's most recent conviction for committing the sexually violent offense or crime against a child.
