Title

Resolution amending Common Council File Number 111628, a resolution directing the Division of Intergovernmental Relations-Department of Administration to seek uniform statewide solid waste regulatory reform for dealing in discarded, salvageable and recyclable materials.

Analysis

This resolution amends Common Council File Number 111628, a resolution directing the Division of Intergovernmental Relations-Department of Administration to seek uniform statewide solid waste regulatory reform for dealing in discarded, salvageable and recyclable materials, by adding language expressing support for the development of an electronic scrap metal reporting system, that is all of the following:

 

a) Similar to the Northeastern Wisconsin Property Reporting System (NEWPRS) currently used by the Milwaukee Police Department.

 

b) Able to be used for data-sharing among local, regional and state law enforcement agencies and for the identification and tracking of materials susceptible to theft and conversion in salvage and recycling operations, including ferrous and non-ferrous metals and salvage vehicles.

 

c) Only accessible to credentialed law enforcement officers for identifying stolen metal property or persons suspected of crimes involving metal property.

 

d) If administered by a third party, guaranteed secure against data breaches and the sale of confidential business information.

 

Body

Whereas, On April 11, 2012, the Common Council passed File Number 111628, a resolution directing the Division of Intergovernmental Relations-Department of Administration (IRD) to seek uniform statewide solid waste regulatory reform for dealing in discarded, salvageable and recyclable materials; and

 

Whereas, File Number 111628 directed IRD to “support the development and operation of systems for data-sharing among local, regional and state law enforcement agencies that will allow the identification and tracking of materials susceptible to theft and conversion in salvage and recycling operations such as the Northeastern Wisconsin Property Reporting System (NEWPRS) currently utilized by the Milwaukee Police Department”; and

 

Whereas, According to the Council of State Governments, because metal theft is such a significant and widespread problem, and because accurately tracking metal theft is key to establishing evidence-based practices designed to both deter theft and assist in the investigation and prosecution of theft, it is imperative that states evaluate ways to begin collecting these data; and

 

Whereas, Several states have already implemented legislation creating statewide scrap metal reporting systems, including Arizona, Minnesota, Nevada and New Hampshire; and

 

Whereas, The Recycling, Salvage and Scrap Metal Task Force recommended in its January, 2015, report the implementation of a single, statewide reporting system administered by the Wisconsin Department of Justice; and

 

Whereas, Due to the sensitive nature of the confidential business information required to be reported in such systems, licensed junk dealers in the city need to be assured that electronic records are only shared with other law enforcement officers or agencies; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that Common Council File Number 111628 is amended by replacing item 2 in the “Resolved” clause with the following:

 

“2. Support the development of an electronic scrap metal reporting system that is all of the following:

 

a) Similar to the Northeastern Wisconsin Property Reporting System (NEWPRS) currently used by the Milwaukee Police Department.

 

b) Able to be used for data-sharing among local, regional and state law enforcement agencies and for the identification and tracking of materials susceptible to theft and conversion in salvage and recycling operations, including ferrous and non-ferrous metals and salvage vehicles.

 

c) Only accessible to credentialed law enforcement officers for identifying stolen metal property or persons suspected of crimes involving metal property.

 

d) If administered by a third party, guaranteed secure against data breaches and the sale of confidential business information.”
