William Judge The Department of City Development (DCD) reports that the tax foreclosed prperty is not suitable for use by a public agency or community based organization. The property is in the Near West Side Planning Area but is not needed to implement the plan. However,, DCD objects to returning the property to the representative for the former owner: the property is not fit for human habitation. The property consists of a duplex and a single family structure. The occupied singel family portion of the parcel is full of personal items and requires many repairs. The rehab estimate for the duplex is $121,034.00 and for the single family is $63,578.00, the total cost to rehab all structure on the parcel is $184,613.00 and the total assessed value for the parcel is $42,400.00 The single family structure was occupied at the time the City foreclosed action. The occupants were given notice to vacate the property by September 30, 2015 due to building conditions. Administrative costs incurred by DCD total $867.77 DNS charges reinspection fees $3,549.00 vacant building fees of $2,332.20 TOTAL DNS charges $5,881.20 due by noon October 12, 2015 2013-2014 Taxes If paid by October $18,970.54 If paid by November 12, 2015 $19,204.40

Body
Whereas, The property located at 1201-1207 W. Juneau Avenue, previously owned by Kathryn Renee Hutchins (application made by Anton Lavender), has delinquent taxes for 2013-2014 and was foreclosed upon pursuant to Sec. 75.521, Wis. Stats., and a fee simple absolute was obtained in favor of the City of Milwaukee dated June 8, 2015 150682; and

Whereas, Kathryn Renee Hutchins (application made by Anton Lavender) would like to reclaim said property by paying all City and County real estate taxes, plus accrued interest and penalties to date of payment, and all costs as sustained by the City in the foreclosing and management of said property since June 8, 2015; and

Whereas, Kathryn Renee Hutchins (application made by Anton Lavender) has agreed to pay all related city charges up until the point that the property is returned, as well as all charges and conditions which are detailed in the letters submitted by the Department of Neighborhood Services, Department of City Development, the Health Department and the Treasurer’s Office, as though set forth in this resolution; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that in order to return the property at 1201-1207 W. Juneau Avenue, a cashier's check must be submitted in the amount indicated by the City Treasurer within thirty (30) calendar days of the adoption of this resolution; and, be it

Further Resolved, That the City Attorney is then authorized to enter into a stipulation with the former owner to reopen and vacate the City's judgment in Milwaukee County Circuit Court Case No 15CV-1661....
