Title
An ordinance relating to the exemption of painting studios from certain regulations for licensed alcohol beverage premises.

Analysis
This ordinance adds “painting studio” to:
1. The list of establishments exempt from the prohibition on the granting of a Class “B” fermented malt beverage retailer license to a premises where any other business is conducted in connection with the premises.
2. The list of establishments exempt from the prohibition on a Class “B” fermented malt beverage and intoxicating liquor retailer licensee or Class “B” service bar licensee from permitting a patron to enter or remain on the licensed premises between the hours of 2 a.m. and 6 a.m.
3. The list of establishments licensed for the retail sale of alcohol beverages which underage persons not accompanied by a parent, guardian or spouse may enter.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 90-1-22 of the code is created to read:
90-1. Definitions.
22. PAINTING STUDIO means an establishment that is primarily engaged in the business of providing to customers instruction in the art of painting and that offers customers to purchase food and beverages for consumption while they paint.
Part 2. Section 90-4.5-7 of the code is created to read;
90-4.5. Limitations on Other Business; Class “B” Premises.
7. A painting studio.
Part 3. Section 90-15-3-a-2 of the code is amended to read:
90-15. Hours of Operation.
3. CLASS “B” FERMENTED MALT BEVERAGE AND INTOXICATING LIQUOR RETAILER LICENSES OR CLASS “B” SERVICE BAR LICENSE.
a. Closing Hours - Prohibited Hours.
a-2. Hotels and restaurants the principal business of which is the furnishing of food, drinks or lodging to patrons, bowling centers, >>painting studios,<< indoor horseshoe-pitching facilities, curling clubs, golf courses and golf clubhouses may remain open for the conduct of their regular business but may not sell intoxicating liquor or fermented malt beverages during the prohibited hours under subd. 1.
Part 4. Section 90-19-1-c of the code is amended to read:
90-19. Presence of Underage Persons in Places of Sale; Penalty.
1. RESTRICTIONS.
c. Hotels, drug stores, grocery stores, bowling alleys, movie theaters, >>painting studios,<< cars operated by any railroad, regularly established athletic fields, stadiums, public facilities as defined in s. 125,51(5)(b)1.2., Wis. Stats., which are owned by a county or municipality >>,<< or centers for the visual or performing arts.
