Analysis
State statutes provide that school bus operators shall not use flashing red or amber warning lights in residence or business districts when pupils or other authorized passengers are to be loaded or unloaded where a sidewalk and curb are laid on both sides of the road, unless required otherwise by municipal ordinance. This ordinance requires school bus operators to use flashing red or amber warning lights in residence and business districts where a sidewalk and curb are laid on both sides of the road. Specifically, this ordinance provides that the operator of a school bus equipped with flashing red and amber warning lights shall do all of the following when stopping to load or unload pupils or other authorized passengers, regardless of whether the stopping location is in a business or residence district and a sidewalk and curb are laid on both sides of the road:
a. Actuate the flashing amber warning lights at least 300 feet before stopping in a 45 miles-per-hour or greater speed zone or at least 100 feet before stopping in a less than 45 miles-per-hour speed zone.
b. At the point of loading or unloading, bring the bus to a stop and:
b-1. If the school bus operator has to stop the bus wholly or partially in a traffic lane on a one-way street or 2-way street with only 2 traffic lanes, at a location that is not an intersection controlled by a traffic signal, extinguish the flashing amber warning lights and actuate the flashing red warning lights.
b-2. If the situation is not as described in subd. 1, keep the flashing amber warning lights actuated but not actuate the flashing red warning lights.
c. After loading or unloading is completed, extinguish the flashing red warning lights or flashing amber warning lights, as the case may be.
