Analysis

This resolution authorizes the proper City officers to execute a Quit Claim Deed (QCD-2856) document conveying the 15-inch combined sewer located in vacated East Madison Street from a point east of South 1^st Street to vacated South Barclay St to Citizens Bank Mukwonago, in the 12^th Aldermanic District. The sewer is being conveyed because it is no longer needed for public use.

Body

Whereas, In 1976, the City of Milwaukee constructed an 15-inch diameter combined sewer in vacated East Madison Street from a point east of the east line of South 1^st Street to vacated South Barclay Street; and

Whereas, Said East Madison Street was vacated on December 16, 2014 per Resolution No.141870; and

Whereas, The vacated lands are now part of Citizens Bank Mukwonago; and

Whereas, Due to the vacation of said portion of East Madison Street, the combined sewer no longer serves the public interest; and

Whereas, Citizens Bank Mukwonago has agreed to accept ownership of said combined sewer; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers, including the DPW Commissioner, are hereby authorized: (i) to sign the Quit Claim Deed document (QCD-2856), in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
