Minutes note: Applicant and Ald. Bauman at the table. Ald. Coggs moves to make affidavit of service part of the record. Prevailed 4-0. (Ald. Zielinski excused.) Ald. Hamilton moves to make the complete police report part of the record. Prevailed 4-0. (Ald. Zielinski excused.) Ald. Zielinski at the table at 8:15 a.m. Mr. Rizvi says that the paraphernalia charge occurred while he was just a worker at another location on Green Bay Rd. Ald. Bauman says that the food license was issued in error due to a lack of a disposition on the second charge of the police report. Rebecca Grill says that the applicant has a cigarette license at the location where he was cited for Possession of Drug Paraphernalia, and he is listed as the agent and only officer at the location. Regarding the first charge on the police report, Mr. Rizvi said it was the result of an altercation with a customer. The customer took money that did not belong to her and the applicant ran outside and confronted the customer at her car. The police came later and gave him a disorderly conduct ticket. Assistant City Attorney Tom Miller asks what the item was that resulted in the drug paraphernalia charge. Mr. Rizvi said that it was the "rose in plastic tube" product. He says he was unaware that that product was considered by police as drug paraphernalia when sold in convenience stores and gas stations and illegal. Ald. Bauman said that the Health Department sent the applicant a letter saying that his food license was void. He also says that he would most likely object to the license if the applicant was not the nephew of Jay Walia, a well-known operator of gas stations who is also the owner of the property. Ald. Zielinski moves to grant despite matters contained in the police report. Prevailed 5-0.
