Analysis
This resolution permits the City of Milwaukee to grant a temporary limited easement for highway reconstruction.
Body
Whereas, The Wisconsin Department of Transportation (“WisDOT”) is undertaking a highway improvement project to improve Silver Spring Drive and needs to acquire easement rights along North 77th Street; and

Whereas, Land needed for the improvements are part of 5611-13 North 77th Street (the “Property”) that is owned by the City of Milwaukee (“City”) and leased to the Housing Authority of the City of Milwaukee (“HACM”) under a ground lease and option to purchase and improved with a scattered site housing unit; and

Whereas, WisDOT presented the City as the fee owner with an appraisal and offer to acquire property rights at the property consisting of acquisition of a temporary limited easement for use of 0.021 acres of the site for construction staging; and

Whereas, The appraisal presented by WisDOT has been review by the City Real Estate staff and a negotiated settlement has been reached with WisDOT, the City and HACM to acquire easement rights, in the total amount of $400; and

Whereas, HACM approved the easement on June 10, 2015; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of the Department of City Development (“Commissioner”), or designee, is authorized to execute the easement, and other documents necessary to grant the temporary limited easement to the State of Wisconsin, and to take such further acts as are or may be necessary to effectuate this resolution; and be it
