Analysis
This resolution authorizes settlement of litigation pending in the United States District Court for the Eastern District of Wisconsin, Danyall Simpson, et al. v. James Langer, et al., U.S.D.C. Case Number 12-CV-500in the amount of Seventy Five Thousand and no/100 Dollars ($75,000) for all damages of any nature, including compensatory, punitive, and consequential damages, or other economic damages, attorneys fees and costs, and any other claim for damages that could be brought concerning the subject matter of the litigation, including subrogated claims.
Body
Whereas, Danyall Simpson filed suit against the City of Milwaukee, former Police Officer James Langer, and Police Officer Zoe Jackson in the United States District Court for the Eastern District of Wisconsin, alleging that the Defendants had violated his civil rights in relation to the actions of Milwaukee police officers in furtherance of a criminal damage to property investigation on May 21, 2006; and

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it is expeditious and just to settle this claim, and now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that upon execution of a settlement agreement, in a form approved by the City Attorney, the proper City officers be and hereby are directed to issue a City check in the amount of $75,000 to Danyall Simpson, payable to the trust account of his attorney, Jonathan Safran of Samster, Konkel & Safran, S.C., upon receipt of a release of claims, approved as to form and execution by the City Attorney, and that these funds shall be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300.
