Title
Resolution relative to acceptance and funding of a State of Wisconsin Department of Natural Resources Municipal Flood Control Grant, on behalf of Milwaukee Metropolitan Sewerage District, to acquire and raze the property at 980 West College Avenue and authorizing the Commissioner of Public Works to execute an Intergovernmental Cooperation Agreement between the City of Milwaukee and the Milwaukee Metropolitan Sewerage District.
 
Analysis
This  resolution authorizes the Department of Public Works Infrastructure Services Division to accept and fund, on behalf of Milwaukee Metropolitan Sewerage District, a State of Wisconsin Department of Natural Resources Municipal Flood Control grant. The project is estimated to cost $457,500, of which, 70% of the total estimated cost, up to a maximum of $320, 250, will be grantor share and the remaining $137,250 shall be borne by Milwaukee Metropolitan Sewerage District. The grant would allow Milwaukee Metropolitan Sewerage District to appraise, acquire and raze one property located at 980 West College Avenue and maintain the site as an open space to prevent future flood related damages. This resolution also authorizes the Commissioner of Public Works to execute a Grant Award Agreement between the City and the Wisconsin Department of Natural Resources and an Intergovernmental Cooperation Agreement between the City and Milwaukee Metropolitan Sewerage District.
 
Body
Whereas, The property at 980 West College Avenue (Property), identified as a severely flood prone property, has had repetitive flood damages; and
 
Whereas, The Property is located in the flood plain of the North Branch Oak Creek, which Milwaukee Metropolitan Sewerage District (MMSD) has jurisdiction over; and
 
Whereas, MMSD has determined that the only viable solution to the flooding problem at the property is to acquire the Property and raze the structure; and
 
Whereas, Only municipalities are eligible to apply for a Municipal Flood Control grant from the State of Wisconsin Department of Natural Resources (DNR), and therefore, the City, on behalf of MMSD, applied for and was awarded the grant to acquire and raze the property; and
 
Whereas, The Property is being acquired with the consent of the of the property owner; and
 
Whereas, The DNR would provide a maximum cost share of up to 70% of the total project cost of $457,500 with a total grantor share not to exceed $320,250 and the remaining $137,250 being borne by MMSD; and
 
Whereas, In order to establish the terms and conditions for the management of the grant and the administration of the acquisition and removal of the Property, the DNR requires that the City and MMSD enter into an Intergovernmental Cooperation Agreement (ICA); and
 
Whereas, MMSD has prepared the ICA which stipulates that the project will have no fiscal impact on the City; and
 
Whereas, The ICA also stipulates that MMSD will pay all costs related to the acquisition and razing of the property up front and that it will send its invoices to the City to be forwarded to the DNR for reimbursement and that once the City receives the funds, it will transmit them to MMSD; and
 
Whereas, MMSD will maintain records documenting all expenditures made during the Municipal Flood Control Grant project; now, therefore, be it  
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to accept such a grant without further Common Council approval unless the terms of the grant change as provided in s. 304-81 of the Milwaukee Code of Ordinances; and, be it
 
Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, Infrastructure Services Division which is authorized to transmit the amounts budgeted for the specific purposes as indicated in the grant budgets; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to execute a Grant Award Agreement between the City and the DNR regarding the Municipal Flood Control Grant, , said Grant Award Agreement being attached to this Common Council Resolution File Number 150020 and incorporated in this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That the Commissioner of Public Works is hereby authorized to execute the Intergovernmental Cooperation Agreement between the City and MMSD establishing the terms and conditions for the acquisition and removal of the Property, said ICA being attached to this Common Council Resolution File Number 150020 and incorporated in this resolution by reference as though set forth in full.
