Analysis
This resolution requires, the Union Pacific Railroad to repair its at-grade crossing with North 119th Street, north of West Hampton Avenue, to good condition within 30 days of the date of adoption of the resolution.
Body
Whereas, Section 86.12(1), Wis. Stats., requires all railroad companies owning or operating tracks that cross streets at grade to keep the surface of the crossings between the tracks and rails and extending 4 feet on either side of the outside rails “in good condition and repair for highway travel”; and

Whereas, Section 86.12(1) further provides that the common council of a city in which a railroad crossing is located may, by resolution, require the railroad company owning or operating the tracks at the crossing to “pave, plank, repair, change or otherwise improve” the crossing; and

Whereas, The Common Council finds that the Union Pacific Railroad crossing on North 119th Street, located approximately 1,700 feet north of West Hampton Avenue, is in a deteriorated and deplorable condition; and

Whereas, The Common Council further finds that the condition of this Union Pacific Railroad crossing is detrimental to businesses located in the area and to their customers and employees; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the City of Milwaukee requires the Union Pacific Railroad to repair its crossing with North 119th Street, north of West Hampton Avenue, to good condition within 30 days of the date of adoption of this resolution; and, be it

Further Resolved, That the City Clerk shall, by certified mail, serve a copy of this resolution on the local agent of the Union Pacific Railroad: John Venice, Manager of Industry and Public Projects, Union Pacific Railroad, 101 North Wacker Drive, ...
