Whereas, The Common Council of the City of Milwaukee previously adopted File Number 131728, which authorized the City Engineer to apply for five Federal Transportation Alternatives Program grants for the 2014-2018 application cycle, with an 80 percent grantor share and a 20 percent local share; and
Whereas, Preliminary approval has been requested and received from the Wisconsin Department of Transportation, along with a Project Agreement to be executed by the City of Milwaukee, for the design of and procurement for a Citywide Bicycle Parking Program under the 2015 federal Transportation Alternatives Program; and
Whereas, The approved project will implement a citywide bicycle parking program to include establishing and administering a cost-share bicycle parking program and procuring various types of bicycle parking equipment to be installed at locations to be determined throughout the city to increase secure parking options for persons who travel by bicycle; and
Whereas, the Wisconsin Department of Transportation has submitted a Project Agreement for execution by the City of Milwaukee for the design and procurement phases of:

; and
Whereas, The State cannot proceed with any project cost overruns and changes in scope of more than 5% without prior Department of Public Works approval; and
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns and changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the Comptroller are authorized to execute the Project Agreement for the design and procurement phases of the aforementioned project with federal Transportation Alternatives Program funds, copies of which are attached to and incorporated in this resolution by reference as though set forth in full; and, be it
Further Resolved, That the proper City of Milwaukee official is hereby directed to undertake design and procurement phases for the aforementioned project, which is anticipated to begin in 2015, and to reimburse the Wisconsin Department of Transportation for design and procurement costs it incurs for the improvements; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for design and procurement for the projects (expenditure) and transfer to any of these accounts the amount required under this grant agreement and City Accounting policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and the local share or $5,000, whichever is greater as follows:
