Analysis
This resolution authorizes the Commissioner of Public Works and Comptroller to execute the revised State and Municipal Agreement with the Wisconsin Department of Transportation to transfer funds between two separate projects originally funded under the Wisconsin Department of Transportation 2014-2015 STP- Freight Pilot Program to improve oversized freight movement and access.  These agreements will transfer funds from a previously approved Freight Program project at West Lisbon Avenue and North 27th Street to provide additional funds for the design and construction of roadway geometric improvements on East Ward Street at its intersections with South Allis Street and East Bay Street.  Geometric improvements designed to enhance freight movement at the intersection of West Lisbon Avenue and North 27th Street will be implemented with the Federal Aid Paving Project on North 27th Street scheduled for construction in 2017.  The total estimated cost for design and construction of both projects under the revised agreements is $285,000 with a grantor share of $212,800 and a City share of $72,200.

Whereas, A Wisconsin Department of Transportation 2014-2015 STP-Freight Pilot Program Project Grant Application was submitted for the improvement of intersection roadway geometrics on West Lisbon Avenue at its intersection with North 27th Street and East Ward Street at its intersections with South Allis Street and East Bay Street to facilitate movement of oversized freight loads to support business and industry in the City of Milwaukee; and
 
Whereas, The Common Council of the City of Milwaukee previously approved the execution of two project agreements for preliminary engineering and construction of roadway geometric improvements at these intersections under Common Council File Numbers 130944 and 130950; and
 
Whereas, North 27th Street from West Highland Boulevard to West Lisbon Avenue is currently scheduled to be paved in 2017 under the Federal Aid Paving Program; and
 
Whereas, Roadway geometric improvements designed for the intersection of West Lisbon Avenue and North 27th Street under the STP-Freight Pilot Program can be constructed in conjunction with the Federal Aid Paving of North 27th Street; and
 
Whereas; Remaining funds from the Freight Pilot Program project at West Lisbon Avenue and North 27th Street can be used to fund additional preliminary engineering and construction costs for the project at East Ward Street at its intersections with South Allis Street and East Bay Street; and
 
Whereas, Preliminary approval has been requested and received from the Wisconsin Department of Transportation, along with a State Municipal Agreement to be executed by the City of Milwaukee, to transfer remaining funds from the STP - Freight Pilot Program project at West  Lisbon Avenue and North 27th Street to provide additional funds for the design and construction of roadway geometric improvements on East Ward Street at its intersections with South Allis Street and East Bay Street; and
 
Whereas, The Wisconsin Department of Transportation has prepared a State Municipal Agreement for execution by the City of Milwaukee for the design and construction of:

Whereas, The State cannot proceed with any project cost overruns or changes in scope of more than 5% without prior Department of Public Works approval; and
 
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and/or changes in scope approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns or changes in scope as approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the Comptroller are authorized to execute two revised State and Municipal Agreements for the programming, design and construction of the aforementioned projects with Wisconsin Department of Transportation 2014-2015 STP - Freight Pilot Program funds, copies of which are attached to and incorporated in this resolution by reference as though set forth in full; and, be it
 
Further Resolved, That the proper City of Milwaukee official is hereby directed to complete preliminary engineering for these projects and to reimburse the Wisconsin Department of Transportation for preliminary engineering costs they incur for the improvements; and, be it
 
Further Resolved, That the Department of Public Works shall request in a future resolution funding for the construction phase of this project; and, be it
 
Further Resolved, That the City Comptroller is hereby authorized to adjust within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for preliminary engineering for the project (expenditure) and transfer to any of these accounts the amount required under this grant agreement and City Accounting policy, but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and the local share or $5,000, whichever is greater as follows:
