Analysis
This ordinance:
1. Classifies a dialysis establishment as a medical office, rather than as a medical service facility, for zoning purposes.
2. Defines 3 land uses involving the production and packaging of alcohol beverages - “brewpub,” “micro alcohol beverage facility” and “large alcohol beverage facility”.
3. Defines “food processing” as a separate and distinct land use.
4. Removes the processing and packaging of alcohol beverages from the definition of “heavy manufacturing”.
5. Removes food processing from the definition of “light manufacturing”.
6. Classifies a brewpub as a special use in the neighborhood shopping zoning districts, as a limited use in the industrial-office, industrial-light and industrial-heavy zoning districts, and as a permitted use in the local business, commercial service, regional shopping and industrial-mixed zoning districts and all downtown zoning districts except the C9A (high-density residential) district. A brewpub is a prohibited use in all other zoning districts.
7. Classifies a micro alcohol beverage facility as a special use in the local business (except LB3) and regional business districts, and as a permitted use in the commercial service, industrial-office, industrial-light, industrial-mixed, industrial-heavy, C9G (mixed activity) and C9H (warehousing and light manufacturing) districts. A micro alcohol beverage facility is a prohibited use in all other zoning districts.
8. Classifies a large alcohol beverage facility as a special use in the industrial-office and industrial-mixed districts, as a limited use in the C9G (mixed activity), C9H (warehousing and light manufacturing) and industrial-light districts, and as a permitted use in the industrial-heavy districts. A large alcohol beverage facility is a prohibited use in all other zoning districts.
9. Classifies food processing as a limited use in the local business, commercial service, regional business, C9B (residential and specialty use), C9C (neighborhood retail), C9E (major retail) and C9F (office and service) zoning districts, and as a permitted use in the industrial-office, industrial-light, industrial-mixed, C9G (mixed activity) and C9H (warehousing and light manufacturing) districts. Food processing is a prohibited use in all other zoning districts.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 295-201-20, 20.5, 70 and 220 of the code is created to read:
295-201. Definitions.
20. ALCOHOL BEVERAGE PRODUCTION FACILITY, MICRO means an establishment that produces and packages up to 20,000 barrels of fermented malt beverages, up to 200,000 gallons of vinous spirits or up to 30,000 gallons of distilled spirits annually, primarily for wholesale distribution and off-premises consumption.
20.5. ALCOHOL BEVERAGE PRODUCTION FACILITY, LARGE means an establishment that produces and packages more than 20,000 barrels of fermented malt beverages, more than 200,000 gallons of vinous spirits or more than 30,000 gallons of distilled spirits annually, primarily for wholesale distribution and off-premises consumption. This term includes ancillary tasting rooms and facility tours.
70. BREWPUB means a tavern or restaurant which contains an on-premises alcohol beverage production facility that produces up to 10,000 barrels of fermented malt beverages, 100,000 gallons of vinous spirits or 15,000 gallons of distilled spirits annually, primarily for on-site consumption or retail sale.
220. FOOD PROCESSING means the preparation, processing, or canning or other packaging of food products. This term does not include the processing or packaging of alcohol beverages or animal or poultry slaughter.
Part 2. Section 295-201-361-a of the code is repealed.
Part 3. Section 295-201-361-b to i of the code is renumbered 295-201-361-a to h.
Part 4. Section 295-201-365, 371 and 375 of the code is amended to read:
365. MANUFACTURING, LIGHT means an establishment engaged in the indoor manufacturing, assembly, fabrication, packaging or other industrial processing of finished parts or products, primarily from previously prepared materials, or the indoor provision of industrial services, where there are few external effects across property lines. This term includes, but is not limited to, a business engaged in the processing, fabrication, assembly, treatment or packaging of [[food,]] textile, leather, wood, paper, chemical, plastic or metal products, but does not include basic industrial processing from raw materials.
371. MEDICAL OFFICE means an establishment providing diagnostic and outpatient medical care on a routine basis, but which is unable to provide prolonged inpatient medical or surgical care. Such facility may be staffed by up to 3 doctors, dentists, ophthalmologists, optometrists, chiropractors, physical therapists or similar practitioners licensed for practice by the state. This term includes a medical or dental laboratory incidental to the medical office use >>, as well as a dialysis establishment<< . See also HEALTH CLINIC.
375. MEDICAL SERVICE FACILITY means an establishment operated such that physicians are present during less than 50 percent of normal business hours and which provides medical services for the specialized diagnosis, testing and treatment of alcoholism, chemical substance abuse, mental illness or sexually transmitted diseases. This term includes, but is not limited to, a facility offering methadone treatment programs, a prison parole or probation drug treatment distribution center, or a facility where components of human blood are removed and purchased for use in research or the manufacture of consumer or industrial products >>, but does not include a dialysis establishment<< .
Part 5. Section 295-203-6-a and e of the code is amended to read:
295-203. Use Definitions.

Part 24. Section 295-803-2-cc to ii is renumbered 295-803-2-dd to jj.
Part 25. Section 295-803-2-cc of the code is created to read:
cc. Large Alcohol Beverage Facility. Annual production of fermented malt beverages shall not exceed 70,000 barrels. If annual production of fermented malt beverages exceeds 70,000 barrels or the facility produces vinous or distilled spirits, the facility shall be a special use.
