Analysis
Resolution authorizing the Commissioner of Public Works to negotiate and execute a State Municipal Agreement for final design and construction between the City of Milwaukee and the Wisconsin Department of Transportation regarding the Lakefront Gateway Project which will be incorporated into and coordinated with the rehabilitation of the Hoan Bridge and portions of IH 794, with the total cost being $29,157,500 of which $16,000,000 is Federal/State-funded and $13,157,500 is City-funded.
 
Body
Whereas, The Wisconsin Department of Transportation will be rehabilitating the Hoan Bridge between Car Ferry Drive and the Lake Interchange and rehabilitating and reconstructing portions of IH 794 between the Milwaukee River and the Lake Interchange between 2013 and 2015; and
 
Whereas, The final stage of the Hoan Bridge/IH 794 project will include the construction of the Lakefront Gateway Project; and
 
Whereas, The execution of the Memorandum of Understanding authorized by the Common Council File No 121684 allowed the development of the State Municipal Agreement for Preliminary Engineering Plan Development for the Lakefront Gateway Project; and
 
Whereas, The execution of the State Municipal Agreement for Preliminary Engineering Plan Development authorized by the Common Council File No 131303 established an understanding between the Department of Public Works and the Wisconsin Department of Transportation on the process to implement the individual project elements; and
 
Whereas, The Lakefront Gateway Project will improve access to the Third Ward, Discovery World, the Art Museum and Summerfest; and
 
Whereas, The Lakefront Gateway Project will improve pedestrian, bicycle and transit access to the Lakefront area; and
 
Whereas, The Lakefront Gateway Project will open Clybourn Street to a median divided two-way facility between Harbor Drive and Van Buren Street; and will extend Lincoln Memorial Drive from the intersection with Clybourn Street to a point south of Chicago Street intersecting with Harbor Drive; and
 
Whereas, The Lakefront Gateway Project will relocate and consolidate the IH 794 ramps to Lincoln Memorial Drive underneath the Current IH 794 mainline structures to create one or more developable parcels in an area located south of Clybourn Street and east of Van Buren Street; and
 
Whereas, The City of Milwaukee and the Wisconsin Department of Transportation have established a project team that has cooperatively guided the Preliminary Engineering Plan Development phase developing a project that best meets the needs of the City, the County, the State and the stakeholders adjacent to the project; and
 
Whereas, The project team will cooperatively guide the Final Design and Construction phases; and  
 
Whereas, The timeframe of proceeding with the Final Design and Construction is critical to coordinating the Lakefront Gateway Project with the overall schedule of the Hoan Bridge/IH 794
project; and
 
Whereas, It is now in the interest of both the City and the Wisconsin Department of Transportation to seek authority to allow the proper City officials to enter into the State Municipal Agreement for Final Design and Construction so that the Lakefront Gateway Project may proceed to the benefit of all parties; and
 
Whereas, The State cannot proceed with any project cost overruns and changes in scope of more than 5% without prior Department of Public Works approval; and
 
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns and changes in scope approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any project cost overruns and changes in scope as approved by the Department of Public Works; and
 
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are hereby authorized to negotiate and enter into a State Municipal Agreement for Final Design and Construction, a draft of which is attached to this file by reference and included in this file as though set forth in full, and to facilitate the City's overall participation in the project in a manner most beneficial to the City and its citizens; and, be it
 
Further Resolved, That non-substantive changes in the State Municipal Agreement for Preliminary Engineering Plan Development may be made by the Commissioner of Public Works and the City Engineer in order to clarify, better define responsibilities as necessary and include additional nonfinancial elements as necessary.
