All members of the Common Council indicated reading the report and recommendations of the Licenses Committee and the exceptions filed under this matter. The question was put: Are any of the following or their counsels present and, if so, do they wish to address the Common Council: Tremaine Brown Mr. Brown indiciated that he wishes to address the Common Council. Ald. Zielinski moved that the Common Council resolve itself into a Committee of the Whole for the purposes of hearing oral arguments on behalf of the complainant or the licenses in opposition to the report and recommendation and then a statement by the City Attorney. There were no objections. Mr. Brown appeared and addressed the Common Council. Assistant City Attorney Adam Stephens appeared and addressed the Common Council. Ald. Zielinski moved that the committee now rises. There were no objections. The question was put: Are there any motions relative to this matter? There were no motions made. Michael Whitcomb present with the applicant. In the May incident, the establishment was part of a downtown operation by the police department where numerous establishments were cited. It was a reminder to all establishments to be more vigilant. The establishment was carding everyone in line, but a police aide snuck in through the line. Additional security has been hired. On July 27th there was a large crowd influx due to an outside event. The establishment was not prepared, but has worked on preventing future problems. They have had no issues since. He states that items #7 and #10 on the police report are related to rental properties and taken care of. In regards to item #8, the employees involved have been terminated. #9 is a pending charge. In regards to item #12, there was a miscommunication and the applicant is working on resolving the issue. The applicant has implemented an improved ID checking system. The establishment is an award winning sushi restaurant and has lost about 44% of revenue because of loss of the alcohol license. The applicant will ensure that all employees that should have a license will be licensed. In regards to item #4 on the police report, two individuals began fighting and security broke them up. The security guard had to pick up person and bring him outside. In regards to item #5, there was a fight outside, but because closing times were not staggered it is unclear where the individual involved came from. In regards to item #6, a fight started outside and security held the individuals involved until police arrived. In regards to item #7, patrons of 618 Live had been fighting, were removed, and began fighting outside. One individual involved may have come from Ultra Lounge. The applicant has met with the police department. He has purchased an ID scanner, but it hasn't been used yet as the entrance to the establishment will need to be reconfigured to accomodate the scanner. The applicant agreed at a meeting with the police department to have staggered exit times from 618 Live. Since staggered times have been implemented, there have not been any fights outside. In regards to item #9, two individuals who had come to the establishment together began fighting. Security guards broke up the fight and the applicant called police. One of the individuals left immediately. Regarding item #9, the underage individual who gained access used a fake ID and the security guard was fired as a result. The applicant is working on paying for fines related to item #11. In regards to item #12, the business was getting ready to shut down and people taking a picture together began fighting. A security guard needed to physically remove the person and a window was kicked during incident. They have contacted police and other establishments for advice and have had no incidents in the last two months. The establishment does have a banned patron list. They initially had internal security with 2 guards at the door and 4-5 inside. They have increased security to 8 inside and 3 outside. He states they have not accused 618 Live of anything and are not in competition. He states that security escorts patrons to cars, but they are in plain clothes and they do not have as many guards as 618. They have had some learning experiences and know that improvements need to be made. There is a dress code with no baggy clothes or hoodies. Last year the applicant stated at committee that the business would close 15 minutes prior to 618. There was a large fight on October 4th that required many personnel. The police department has met with both owners because it was unclear which patrons were involved in the fight. At the meeting, the applicant agreed to buy an ID scanner, have staggered closing times, have a common banned list, and have communication with security guards between the establishments. The establishment hasn't been escorting patrons to parking areas. Ideas brought up at the meeting had also already been discussed at the previous committee meeting. On November 19th a minor with a fake ID had been turned away at 618. The fake ID indicated an age of 21, but the individual gained entry to Ultra Lounge despite the 23+ age restriction. Sgt. Ackley - At the meeting with Ultra Lounge and 618, there was a discussion regarding cohesion between security units. There was cohesion at first, but it deteriorated a month later. Closing times weren't being staggered. 618 has kept its closing time, and he can't determine if Ultra has a standard closing time. 618's customers usually park a block or two away and security walks them to parking lots. He has not observed Ultra Lounge helping customers to the parking areas. They have offered assistance in front of the establishment, but not to parking areas. Outside security footage can only be obtained by contacting the building owner and it is difficult to reach him. He is not aware of any dress code at Ultra and hasn't seen any signs posted. 618 has a database from their ID scanners, but there is a lack of communication between clubs. He is concerned about after hours activity, though hasn't observed any issues for a month. About a month ago there were still patrons a minute before closing time. Curtains covering the windows were added about a month ago. He has not seen any signage indicating the age restriction. Individuals appearing in support. The curtains are opened if there are already patrons on the premises. There is a kitchen on the premises. Alexander MaCavene - 8525 W Helena - He is a patron of the establishment. He states the applicant and Mr. Hinton take his input into account as a customer. He states if there is an argument, security and management step in to find out the details of the situation. Samantha Lynn Bigsharp - PO Box 51073 - She states the establishment is the only lounge on Water Street that caters to an urban crowd. She states it is a mature crowd and she feels safe in the establishment. She states Mr. Brown and Mr. Hinton can sit on the second level of the establishment to monitor the crowd.
