Title
Substitute resolution approving a lease agreement between the City of Milwaukee and Milwaukee County for construction of a communication tower located at Milwaukee Fire Department Engine 38, 8463 N. Granville Road.
Analysis
This resolution authorizes the Department of Administration to negotiate and enter into an intergovernmental lease agreement with Milwaukee County for construction of a communication tower located at Milwaukee Fire Department Engine 38, 8463 N. Granville Road. The City shall be responsible for all costs associated with the removal of an existing 180-foot-high tower.  Milwaukee County shall be responsible for all costs associated with the installation, maintenance and operation of a new 250-foot-high tower and equipment shelter.  Both the City and Milwaukee County will share space on the 250-foot-high tower, with each entity responsible for its own equipment placed on this tower.
Body
Whereas, The Department of Administration is the City's sole negotiating agent for marketing City-owned sites for communication services; and
 
Whereas, The City currently operates Milwaukee Fire Department Engine 38 from a fire station located at 8463 N. Granville Road; and
 
Whereas, There is a 180-foot-high, City-owned tower at 8463 N. Granville Road, on which  Milwaukee County currently has installed equipment for the Public Safety Radio System; and
 
Whereas, Milwaukee County wishes to construct a new, 250-foot-high tower and equipment shelter on the property located at 8463 N. Granville Road; and
 
Whereas, The Department of Administration has been working with the City Attorney's Office to negotiate a lease agreement with Milwaukee County for the construction of this communication tower; and
 
Whereas, All cost associated with the removal of the existing 180-foot-high tower will be borne by the City; and
 
Whereas, All costs associated with the installation, maintenance and operation of the new 250-foot-high tower and equipment shelter will be borne by Milwaukee County; and
 
Whereas, Both the City and Milwaukee County will share space on the 250-foot-high tower, with each entity responsible for its own equipment placed on this tower; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Department of Administration is authorized to negotiate and enter into an intergovernmental lease agreement, a copy of which is attached to this file, with Milwaukee County for construction of a communication tower located at Engine 38, 8463 N. Granville Road; and, be it
 
Further Resolved, The proper City officials are authorized to enter into this intergovernmental lease agreement on behalf of the City of Milwaukee.
