Resolution relative to the cost participation and installation of street lighting improvements in conjunction with streetscape improvements under the Transportation Enhancements Program on South Layton Boulevard/South 27th Street (STH 241) from Oklahoma Avenue to West National Avenue in the 8th Aldermanic District at a total estimated cost of $656,252.82., with an estimated grantor share of $525,002.26, and an estimated City share of $131,250.56.
Analysis
This resolution authorizes the Commissioner of Public Works and Comptroller to enter into a funding agreement with the Wisconsin Department of Transportation for installation of street lighting improvements with streetscape improvements under the Transportation Enhancements Program on South Layton Boulevard/South 27th Street (STH 241) from Oklahoma Avenue to West National Avenue in the 8th Aldermanic District at a total estimated cost of $656,252.82, with an estimated grantor share of $525,002.26, and an estimated City share of $131,250.56., and to install these improvements upon execution of the agreement. This resolution also authorizes the Comptroller to transfer funds to the appropriate accounts for the project. The total estimated cost of the entire project is $1,347,626, with a grantor share of $1,078,101 and a City share of $269,525.

Whereas, The Project Agreement for streetscape improvements under the Transportation Enhancements Program on South Layton Boulevard/South 27th Street (STH 241) from Oklahoma Avenue to West National Avenue was approved by the Common Council under File Number 110134; and,
Whereas, The Transportation Enhancements Program provides cost participation for projects that increase multi-modal transportation alternatives and enhance communities and the environment; and
Whereas, The project will include the installation of new Milwaukee Harp and Milwaukee Lantern fixtures throughout the project limits; and
Whereas, The current estimated cost of this project is $656,252.82 for the alteration and upgrade of existing street lighting facilities; and
Whereas, Eighty percent of the participating project cost, or $525,002.26, is reimbursable from the Wisconsin Department of Transportation, and should be earmarked for this project in the 2014 Capital Grant and Aids Projects Fund Project Grant Number SP032140100; and
Whereas, The State cannot proceed with any project cost overruns or changes in scope of more than 5% without prior Department of Public Works approval; and
Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee at the next scheduled meeting of any such project cost overruns or changes in scope approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100% liable for any such project cost overruns or changes in scope as approved by the Department of Public Works; and
Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works and the Comptroller are authorized to enter into a funding agreement and are directed to execute the contract with the Wisconsin Department of Transportation for the installation of street lighting improvements in conjunction with the streetscape improvements to South Layton Boulevard/South 27th Street (STH 241) from Oklahoma Avenue to West National Avenue, a copy of which is attached to this resolution, and is incorporated into this resolution as though set forth in full; and be it
Further Resolved, That upon approval of this contract, that the Commissioner of Public Works is directed to install and modify street lighting facilities in conjunction with the streetscape improvements South Layton Boulevard/South 27th Street (STH 241) from Oklahoma Avenue to West National Avenue; and, be it
Further Resolved, That upon approval of this contract, the City Comptroller is hereby authorized to transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater as follows:
