Title
Resolution relative to application, acceptance and funding of a Green Infrastructure Partnership Program grant funding from the Milwaukee Metropolitan Sewerage District for the installation of permeable pavement in the alley bounded by South 20th Street, West Windlake Avenue and West Arthur Avenue, in the 12th Aldermanic District.
 
Analysis
This resolution authorizes the Department of Public Works, Infrastructure Services Division to apply, accept and fund a Milwaukee Metropolitan Sewerage District Green Infrastructure Partnership Program grant up to a maximum reimbursement amount of $118,286, not to exceed 50% of the total project cost. The purpose of the grant is to install green infrastructure, such as permeable pavement, to help reduce and treat stormwater runoff. The pavement will be installed in the alleys bounded by South 20th Street on the west, West Windlake Avenue on the south and on the east and West Arthur Avenue on the north, in the 12th Aldermanic District.
 
Body
Whereas, The Milwaukee Metropolitan Sewerage District (MMSD) is responsible for collecting and treating wastewater from local sewerage systems; and
 
Whereas, During wet weather events, stormwater enters local sewerage systems, increasing the volume of wastewater that MMSD must convey and treat and enters surface waters, increasing pollution levels in those waterways and increasing the risk of flooding; and
 
Whereas, Green infrastructure, such as permeable pavement, reduces the volume of stormwater in the sewerage system and the amount of pollutants discharged to surface waters; and
 
Whereas, MMSD desires to promote the installation of green infrastructure; and
 
Whereas, The City has applied for Green Infrastructure Partnership Program grant funding from MMSD for the installation of permeable pavement within said alleys; and
 
Whereas, The permeable pavement will be constructed as part of an overall reconstruction project of
said alleys; and
 
Whereas, MMSD has accepted the City's grant application and has awarded the City with a maximum grant amount of $118,286, not to exceed 50% of the total project construction cost; and
 
Whereas, The operation of the grant is effective from the date of execution of the Funding Agreement through July 1, 2016 and is estimated to cost $238,286, of which $118,286 would be provided by MMSD and $120,000 would be provided by the City; and
 
Whereas, Department of Public Works has committed funds for the entire cost of the project (SM493130109) per common council file Number 140706; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to accept and execute such a grant without further Common Council approval unless the terms of the grant change as indicated in Common Council file 030712 (Grant Ordinance); and, be it
 
Further Resolved, That upon approval of this Agreement, the City Comptroller is hereby authorized to create within the Capital Grant and Aid Projects Fund the appropriate Project/Grant Chartfield Value for this project; and transfer to these accounts the amount required under the agreement and City accounting policy, but not to exceed a ten percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater as follows:

Further Resolved, That these funds are appropriated to the Department of Public Works, which is authorized to expend from the amount budgeted for specific purposes as indicated in the grant budgets and incur costs consistent with the award date; and, be it
 
Further Resolved, That the Commissioner of Public Works is authorized to accept and execute the Green Infrastructure Funding Agreement between the City and the MMSD, a copy of which is attached hereto; and, be it
 
Further Resolved, That the Commissioner of Public Works shall have the authority to authorize transfers within the project budget so long as the amount expended for any purpose shall not exceed the amount authorized by the budget by 10% and such transfers are in accordance with grantor regulations; and, be it
 
Further Resolved, That the Commissioner of Public Works on behalf of the City of Milwaukee be authorized to enter into subcontracts (and leases) as detailed in the project budget and in accordance with City purchasing procedures and grant and aid guidelines for awarding such contracts.
