Analysis
This resolution authorizes and directs the proper City Officers to execute Sewer and Water Easement Releases, SER-2184 and WER-448 and Quit Claim Deed QCD-2184 of sewer and water facilities (facilities) located in vacated North Cass Street between East East Wisconsin Avenue and East Mason Street.
Body
Whereas, On Octorber 19, 1977, the City of Milwaukee was granted sewer easement SE-2184 and water easement WE-448 by Northwestern Mutual Life Insurance Company for access and maintenance of the combined sewer, and the 6-inch and 36-inch water mains located in the former North Cass Street right of way; and
Whereas, Said facilities have been relocated by Northwestern Mutual Life Insurance Company in order to develop the lands in vacated North Cass Street, and
Whereas, Sewer Easement SE-2184 and Water Easement WE-448 no longer serve the interest of the City of Milwaukee and should be released with the sewers therein conveyed to the owner and water mains therein abandoned; now, therefore, be it
Resolved, by the Common Council of the City of Milwaukee, that the proper City officers, including the DPW Commissioner, are hereby authorized: (i) to accept Sewer Easement Release, SER-2184, Water Easement Release, WER-448, and Quit Claim Deed, QCD-2184 in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); (ii) to sign the easement release and cause the same to be recorded in the Milwaukee County Register of Deeds Office.
