Analysis
This resolution authorizes the Commissioner of Public Works and the Comptroller to execute the State Municipal Agreement for construction alterations on Milwaukee Water Works, City Underground Conduit, City of Milwaukee-Sanitary Sewer, City of Milwaukee Street Lighting, and City of Milwaukee-Signal facilities in conjunction with the I-43 bridge rehabilitation contract from Howard Avenue to the Valley Bridge. Total estimated cost of $37,396,000, with an estimated grantor share of $37,377,500 and an estimated City share of $18,500.
Body
Whereas, The Wisconsin Department of Transportation has scheduled the rehabilitation of several bridges over I-43 between Howard Avenue and the Valley Bridge in portions of the City of Milwaukee; and
Whereas, The Wisconsin Department of Transportation has scheduled the I-43 bridge rehabilitation contract from Howard Avenue to the Valley Bridge to be constructed in the summer of 2014 until the fall of 2015; and
Whereas, The I-43 bridge rehabilitation contract from Howard Avenue to the Valley Bridge will include rehabilitation of bridges over I-43 at West Howard Avenue, South Chase Avenue, West Lincoln Avenue, West Maple Street, West Mitchell Street, West Lapham Boulevard, West Greenfield Avenue, and West Becher Street and various other miscellaneous construction from Howard Avenue to the Valley Bridge in the City of Milwaukee; and
Whereas, Alterations to Milwaukee Water Works, City Underground Conduit, City of Milwaukee-Sanitary Sewer, City of Milwaukee-Street Lighting, and City of Milwaukee-Signal facilities are necessitated by the I-43 bridge rehabilitation contract from Howard Avenue to the Valley Bridge; and
Whereas, The Wisconsin Department of Transportation has agreed to pay 100% of the costs associated with relocation and adjustment of City of Milwaukee-Street Lighting and Signal facilities; and
Whereas, Wisconsin Statute 84.295(4m) indicates that the Wisconsin Department of Transportation will pay 90% of the cost of alteration, rehabilitation, and relocation of Milwaukee Water Works, City of Milwaukee Sanitary Sewer and City Underground Conduit utilities with the responsible jurisdiction liable for the remaining 10% of the cost; and
Whereas, In order for the City to be reimbursed 100% for the Street Lighting and Signal costs and for the 90% share of the remaining utility alteration construction cost on the I-43 bridge rehabilitation contract from Howard Avenue to the Valley Bridge, the Wisconsin Department of Transportation requires a State Municipal Agreement, in accord with Wisconsin Department of Transportation's relocation assistance policy; and
Whereas, The Wisconsin Department of Transportation has provided the City with the necessary State Municipal Agreement to facilitate reimbursement of the City utility alteration construction costs associated with the I-43 bridge rehabilitation contract from Howard Avenue to the Valley Bridge; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized to execute the State Municipal Agreement for construction alterations on Milwaukee Water Works, City Underground Conduit, City of Milwaukee-Sanitary Sewer, City of Milwaukee-Street Lighting, and City of Milwaukee-Signal facilities in conjunction with the I-43 bridge rehabilitation contract from Howard Avenue to the Valley Bridge, attached to this resolution by reference as though set forth in full; and, be it
Further Resolved, That the funding to cover the 10% City cost of the I-43 bridge rehabilitation contract from Howard Avenue to the Valley Bridge utility alterations for the Milwaukee Water Works, City Underground Conduit, and City of Milwaukee-Sanitary Sewer, estimated to be $9,915, $163,770, and $1,315, respectively, are or will be placed in Department of Public Works Departmental Accounts; and, be it
Further Resolved, That the 10% City of Milwaukee share of the Water Works costs associated with this project have previously been accounted for in the Water Works operations budget; and, be it
Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid projects, the necessary Project Grant Chartfield Values for engineering and construction for the projects (expenditure) and transfer to any of these accounts the amounts required under the grant agreement and City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater, as follows:
