Title
Substitute resolution approving the relocation order and plat for land acquisition for the Beer Line Bicycle Trail Extension: North Richards Street to West Capitol Drive.
Analysis
This resolution approves the relocation order and plat for land acquisition necessary for the City's development of the Beer Line Bicycle Trail Extension from North Richards Street to West Capitol Drive and authorizes the Commissioner of Public Works to sign any documents necessary to acquire the property including agreements with the current owner, Glendale Redevelopment LLC, and Beintween LTD to utilize the property for public art performances prior to acquisition.

Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 110135 on June 28, 2011, authorizing the Commissioner of Public Works to execute a State Municipal Agreement with the Wisconsin Department of Transportation to fund the costs associated with the Beer Line Bicycle Trail Extension project, and the City Comptroller to create within the Capital Projects Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values and transfer funds for preliminary engineering associated with the project; and
Whereas, The Common Council of the City of Milwaukee adopted Resolution File Number 131733 on April 22, 2014, authorizing the initiation of the right-of-way acquisition and directing the transfer of funds for the City of Milwaukee's share of the right-of-way costs for the Federally Aided Local Let Transportation Enhancements project known as "Beer Line Bicycle Trail Extension" with a total estimate cost of $663,615, with a City's share of $132,723 and a Grantor's Share of $530,892.
Whereas, The statutory land acquisition process requires the Common Council to approve a relocation order and right-of-way plat before beginning negotiations to acquire the property from Glendale Redevelopment LLC; and
Whereas, The City would like to lease the property from Glendale Redevelopment LLC at no cost to the City prior to acquiring the land to allow Beintween LTD to hold art performance events at the property while the City negotiates the land acquisition; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Plat of Right-of-Way for the Beer Line Bicycle Trail Extension project and the related relocation order are approved in substantially the same form that is attached to this file, that the land identified in the Plat of Right-of-Way is determined to be necessary for the project and that the Commissioner of Public Works is authorized to sign these documents on the City's behalf; and, be it
Further Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is authorized to execute the Lease Agreement between the City and Glendale Redevelopment LLC and the Right of Entry Agreement and Assignment between the City and Beintween LTD; and, be it
Further Resolved, By the Common Council of the City of Milwaukee that approval of this Resolution is conditioned upon the Federal Highway Administration authorizing the City of Milwaukee to acquire the real estate described in the Plat of Right-of-Way under the Federally Aided Local Let Transportation Enhancements grant.
