Analysis
This resolution grants city approval of Assignment and Assumption of a Special Permission Agreement for the property located at 3305 South 20th Street from Ohio Medical Development LLC to Lakeshore Medical Properties, LLC.
Body
Whereas, The Common Council adopted Resolution File Number 990945 on October 19, 1999, granting Ohio Medical Development, LLC (“Ohio”) a Special Permission to improve and maintain the public alley abutting the property located at 3305 South 20th Street (“the Property”) and to utilize the public alley to access the Property; and

Whereas, Pursuant to Resolution File Number 990945, the City of Milwaukee (“the City”) and Ohio entered into a Special Permission Agreement (“the Agreement”) that was recorded with the Milwaukee County Register of Deeds on January 31, 2000 as document number 38875; and

Whereas, The Agreement requires City approval before Ohio may assign its rights under the Agreement to a third party; and

Whereas, As part of a sale of the Property to Lakeshore Medical Properties, LLC, (“Lakeshore”), Ohio wishes to assign, and Lakeshore wishes to assume Ohio’s rights under the Agreement; and

Whereas, Ohio and Lakeshore have negotiated an Assignment and Assumption of Special Privilege Agreement (“the Assignment”) and submitted the same to the City for review and approval; and

Whereas, The Department of Public Works has reviewed the existing Agreement and has no objection to the Special Permission continuing; and

Whereas, The Office of the City Attorney has reviewed the Assignment and has no objection; now, therefore, be it
