Resolution authorizing conveyances to the Wisconsin Department of Transportation for a portion of the City-owned property at 459 South 84th Street for the Zoo Interchange reconstruction project, in the 10th Aldermanic District.
Analysis
This resolution permits the City of Milwaukee to convey property for freeway reconstruction.
Body
Whereas, The Wisconsin Department of Transportation ("WisDOT") is undertaking a highway improvement project to widen the I-94 freeway and to improve the Zoo Interchange and needs to acquire land along South 84th Street to construct a retaining wall and improve the South 84th Street exit ramp; and
 
Whereas, Land needed for the right-of-way improvements are part of 459 South 84th Street that is owned by the City of Milwaukee ("City") and leased to the Housing Authority of the City of Milwaukee ("HACM") under an April 1971 ground lease and option to purchase and is improved with a scattered site housing unit; and
 
Whereas, WisDOT presented the City, as the fee owner, with an appraisal and offer to acquire property rights at the property consisting of acquisition of 2,309 square feet of land in fee, damages for removal of trees and a temporary limited easement for use of 2,352 square feet of the site for construction staging; and
 
Whereas, The appraisal presented by WisDOT has been reviewed by the City Real Estate staff and a negotiated settlement has been reached among WisDOT, the City and HACM to acquire the fee and easement rights, to compensate for lost landscaping and to make certain improvements during the road construction in the total amount of $17,500; and
 
Whereas, The City and HACM, with the assistance of the City Attorney, negotiated an Agreement Among the Wisconsin Department of Transportation, the Housing Authority of the City of Milwaukee and the City of Milwaukee Regarding 459 South 84th Street ("Agreement"), a copy of which is attached to this Common Council File; and
 
Whereas, HACM approved the Agreement on June 16, 2014; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of the Department of City Development ("Commissioner"), or designee, is authorized to execute the Agreement (or one in substantial conformance therewith), and to execute the deed, easement and other documents necessary to convey title to the State of Wisconsin and to take such further actions as are or may be necessary to effectuate the Agreement and this resolution; and, be it
 
Further Resolved, That the sale proceeds for the fee acquisition of the property of $8,100, less a 30 percent expense reimbursement to the Redevelopment Authority of the City of Milwaukee, shall be deposited in the Tax Deed Fund and the balance of the compensation for the temporary limited easement and landscaping damages of $9,400 shall be deposited with HACM.
