Body
Whereas, The plaintiffs, Tom Reep and other Milwaukee property owners, have filed a lawsuit against the City of Milwaukee, the Milwaukee Metropolitan Sewerage Commission, and Veolia Water for the damage to their property in connection with a sewer backup during a significant ran storm on June 7 and 8, 2008 and which resulted in a judgment against the City of Milwaukee plus interest in the amount of $935,722.56 to the projected payment date of July 1, 2014 ; and
Whereas, The City Attorney determined that it was not appropriate to appeal this judgment; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to pay the judgment in this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials be and are hereby directed to issue a City check in the amount of $935,722.56 payable to the order of the Weiss Berzowski Brady LLP Client Trust Account, in full and final settlement of all monetary damages sought in this lawsuit, including reasonable attorney's fees and costs, on receipt of a Satisfaction of Judgment, approved as to form and execution by the City Attorney, said amount to be charged to Account Number 0490-6831-R999-006300.
