Title
Resolution authorizing the execution of a Right of Entry for maintenance of the 16th Street Viaduct between the City of Milwaukee and the Forest County Potawatomi Community.
 
Analysis
This resolution authorizes execution of a Right of Entry for maintenance of the 16th Street Viaduct along land owned by the Forest County Potawatomi Community.
 
Body
Whereas, The Forest County Potawatomi Community intends to construct an addition to their parking structure on Potawatomi Circle; and
 
Whereas, The expansion of the parking structure necessitates that City forces must enter onto land owned by the Forest County Potawatomi Community to conduct inspections, maintenance and repairs to the 16th Street Viaduct, located directly east of and adjacent to the private property; and
 
Whereas, The City desires a "right of entry" over the private property for the purposes of conducting inspections, maintenance, and repairs to the 16th Street Viaduct; and
 
Whereas, The Forest County Potawatomi Community agrees to grant such a "right of entry", with the terms and conditions set forth in the attached Right of Entry document; now, therefore be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Right of Entry for maintenance of the 16th Street Viaduct between the City of Milwaukee and the Forest County Potawatomi Community, is hereby approved and the proper City officers are hereby authorized and directed to execute and deliver the right of entry agreement in substantially the form for on file with the Common Council, with such minor non-substantive revisions as may be approved by the Commissioner of Public Works and the Office of the City Attorney.
