Analysis

This resolution authorizes a Quit Claim Deed, conveying a 24-inch combined sewer located in West Freshwater Way at South 6^th Street, in the 12^th Aldermanic District.

Body

Whereas, A 24-inch combined sewer was constructed in 1927 to serve the property known today as the Tannery Remnants LLC at 606-622 West Oregon Street; and

Whereas, The combined sewer is connected to a 54-inch Metropolitan Interceptor Sewer, owned by the Milwaukee Metropolitan Sewerage District (MMSD); and

Whereas, Section 2.201(8) of MMSD's Rules and Regulations - General Design Standards, requires such connection of private sewers to MMSD's interceptor sewer to either be eliminated or for the private sewer to be conveyed to a local governmental unit for its use, in which case it may remain connected; and

Whereas, Tannery Remnants LLC desires to develop the lands containing said sewer and has submitted site development plans to MMSD and the City of Milwaukee; and

Whereas, The City has examined the condition of the sewer and is willing to accept ownership of it; and

Whereas, It is in the interest of the City to take ownership of said sewer; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers, including the Commissioner of the Department of Public Works, are hereby authorized: (i) to sign the Quit Claim Deed document (QCD-2846), in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
