Analysis
This resolution authorizes the proper City Officers to execute a Conveyance of Rights to the Wisconsin Department of Transportation entitled "Conveyance of Rights in Land", Custom based on WIDOT Document DT1660, for portions of Water Easements WE826A located north of Interstate Highway 94 and 1600' West of S. 84th St., WE826B located north of Interstate Highway 94 and 1200' West of S. 84th St., WE313 located east of S. 84th St. and north of W. O'Connor St., WE248A located between N. 95th St and the Zoo Freeway, and WE248D located in the Milwaukee County Zoological Park south of W. Blue Mound Rd. and west of the Zoo Freeway, in the 10th Aldermanic District.

Whereas, The Wisconsin Department of Transportation ("WIDOT") Project I.D. No. 1060-33-80 has scheduled the reconstruction, improvement and widening of the Zoo Interchange in the City of Milwaukee; and
Whereas, The WIDOT Project I.D. No.1060-33-24 has created the Plat of Right-of-Way required for the reconstruction, improvement and widening of the Zoo Interchange in the City of Milwaukee; and
Whereas, The WIDOT Conveyance of Rights in Land document has provided the City of Milwaukee Water Utility with a Utility Project ID#1060-38-49 and R/W Parcel No.522; and
Whereas, The WIDOT has requested that the City of Milwaukee provide a Conveyance of Rights in Land and release, in defined areas within the expanded freeway right-of-way, the City's easement rights arising under a 1997 easement (WE826A) Register of Deeds Document No.7465555, a 1997 easement (WE826B) Register of Deeds Document No.7465555, a 1981 easement (WE313) Register of Deeds Document No.4614176 and Document No.5522876, a 1968 easement (WE248A) Register of Deeds Document No.4441561, and a 1969 easement (WE248D) Register of Deeds Document No.4454365; and
Whereas, The areas where the WIDOT has requested that the City of Milwaukee grant the conveyance and release of its easement rights are within parts of each of a parcel north of Interstate Highway 94 and 1600' West of S. 84th St. owned by the Geneva Office Exchange V LLC., a parcel north of Interstate Highway 94 and 1200' West of S. 84th St. owned by the Geneva HC2X XXII LLC, a parcel east of S. 84th St. and north of W. O'Connor St. owned by the Trustees of Milwaukee Boy Scout Fund, a parcel between N. 95th St. and the Zoo Freeway owned by the Montessori Society, and a parcel in the Milwaukee County Zoological Park south of W. Blue Mound Rd. and west of the Zoo Freeway owned by Milwaukee County; and
Whereas, The Conveyance of Rights in Land document indicates that the costs of any relocation or alteration of water facilities within lands described in the document, now or in the future, required by WIDOT for any reason will be paid by WIDOT; and
Whereas, The City of Milwaukee, by its Department of Public Works, with assistance from the City Attorney's Office, negotiated the Conveyance of Rights in Land that is part of this file to accomplish the conveyance, and release of easements; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City Officers, including the Department of Public Works Commissioner, are hereby authorized: (i) to sign the Conveyance of Rights in Land document affecting Water Easements WE826A, WE826B, WE313, WE248A and WE248D, in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
