Analysis
This resolution authorizes a Conveyance of Rights in Land to the Wisconsin Department of Transportation (WISDOT), release of unrecorded sewer easement which area is within 201 South 84th Street, located just north of I-94, Sewer Easement SE-1535 which area is within 135 South 84th Street, located just north of I-94 and approximately 1,650 ft. west of South 84th Street, Sewer Easement SE-1978 which area is within 330 South 84th Street, located just north of West O'Connor Street, and partial release of Sewer Easement SE-1537B which area is within 345 North 95th Street, located approximately 650 ft. south of West Bluemound Road, Sewer Easement SE-1537C which area is within parts of 9915 West Bluemound Road and 9715 West Bluemound Road, located approximately 600 ft. south of West Bluemound Road and just west of I-45, and Sewer Easement SE-1878D which area is within 9128 West Chester Street, located approximately 500 ft. east of South 92nd Street in the 10th Aldermanic District.
Body
Whereas, Wisconsin Department of Transportation (WISDOT)  is undertaking a highway improvement project, WISDOT Project I.D. No. 1060-33-24, concerning improvement to and widening of the Zoo Interchange, and in conjunction therewith, WISDOT has requested that the City of Milwaukee provide a Conveyance of Rights in Land and release, in defined areas within the expanded freeway right-of-way, the City's easement rights arising under an unrecorded easement, a 1961 easement (SE-1535), register of deeds document no. 3907622 and document no. 7380455, a 1981 easement (SE-1978), register of deeds document no. 4614176 and document no. 5522876, and partial release a 1961 easement (SE-1537B), register of deeds document no. 3928123, a 1961 easement (SE-1537C), register of deeds document no. 3928124 and, a 1969 easement (SE-1878D), register of deeds document no. 4440213; and
 
Whereas, The areas where WISDOT wants the City to grant the conveyance and release its easement rights are within parts of each of 201 South 84th Street, owned by the Milwaukee County, County Park Department, 135 South 84th Street, owned by the Geneva Office Exchange V LLC C/O Greywolf Partners, 330 South 84th Street, owned by the Trustees of Milwaukee Boy Scouts Fund, 345 North 95th Street, owned by Wisconsin Montessori Society Inc, 9915 West Bluemound Road, owned by Milwaukee County Register of Deeds, 9715 West Bluemound Road, owned by Milwaukee County Register of Deeds, and 9128 West Chester Street, owned by WISDOT; and
 
Whereas, Within the targeted release areas, the City does have existing sanitary sewer facilities that will no longer be used and that will no longer be needed, and per the Department of Public Works (DPW), the abandonment or removal of these unneeded facilities to separate them from other sanitary sewer facilities that the City would continue to own in other parts of the easement areas that the City would not be releasing is shown in the plans; and
 
Whereas, The City, by its DPW with assistance from the City Attorney's Office, negotiated the Conveyance of Rights in Land that is part of this file to accomplish the conveyance, and release of easements; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers, including the DPW Commissioner, are hereby authorized: (i) to sign the Conveyance of Rights in Land document affecting unrecorded easement, SE-1535, SE-1978, SE-1537B, SE-1537C, and SE-1878D, in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
